Both the Tier 2 Vallco Specific Plan and the SB 35 Plan are financially feasible at the present. However, costs run at approximately $700,000 per day or $21 million per month of delay in starting construction. If there is a referendum or lawsuit challenge which causes a delay, the following penalties apply: Reduced funds to Cupertino Union School District from $14.25 million to $9.5 million – a loss of $4.75 in unrestricted funds to schools; Reduced funds for new Serra Trail, Wolfe/280 improvements from $11 million to $5.5 million – a loss of $5.5 million; Reduced contributions for community shuttle service from 9 years to 4 years – a loss of $3.75 million
