Kansas, Remove the breed ban statewide
The Issue

Thank you for taking the time to contact the Governor’s office and for sharing your thoughts about legislation that does not allow local communities to ban dogs based on their breed. Because a change in law requires an act by the State Legislature, I would encourage you to contact your legislator, if you have not done so yet, to discuss potential legislation. This petition has been changed to the State of Kansas since I feel we will not get anywhere with my cities city council. This way we can spread more awareness.
When you sign please state what city you are from, this will help show what the citizens of each city support.
This petition has been started as a way to spread awareness to a ever growing issue in my community and among many cities in Kansas. A breed ban has affected families in the state of Kansas for to long, the fear of dogs such as pitbulls has got to stop. Since this rule has been enforced in my town, it has been enfroced with an iron fist and involving anyone who has a dog that even "looks" like one of the breeds banned. This seems wrong on so many levels that peoples pets that they have had for many years (be it that this means these types of dogs have been in these towns for quite a while but yet have not been causing issues) are being assumed to be pits/rots etc without evidence. Every basis has been because a dog looks like a breed. To me this is profiling and assuming the person who owns the dog is guilty until proven innocent. All these individuals are having family pets taken that have not caused issues causing hardships and hatred toward not only the ones that have enacted the law but also the ones involved in taking the dogs.
I ask that anyone involved such as those who have had thier dogs taken, harrassed for having a dog looking like a banned breed, those who want this ban overturned and believe that the state of Kansas should overturn this. This petition is meant for the people of the state of Kansas to share this/sign this and show the that the information that is stated about these animals are wrong and that profiling dogs just because of a few incidents is wrong.
Below is an article about the last time the people in our town pushed to change it, the city council benched the discussion telling us we could not een bring it up again. To me the "we the people" means we the citizens not we the city council.

I had to go to court for a first appearance for being ticketed for "dangerous dog in city limits" and when I spoke to the judge about my dog not being built like a rot he suggested I speak with the prosecutor and when I did I showed him pictures of a doberdor, hound dog, a few rots, and my dog and asked if he could tell me the breeds and asked if he could tell me which ones could be my dog? He proceeds to just tell me that if they look like they could be part rot then they can be banned unless proven otherwise. I then asked him if being a service wasn't enough to keep her if I didn't have any other proof that she was I had trained her to be my service dog and help me when I fall due to me having several surgeries and cases where I have fallen and struggled to get up and I had to go to court for a first appearance for being ticketed for "dangerous dog in city limits" and when I spoke to the judge about my dog not being built like a rot he suggested I speak with the prosecutor and when I did I showed him pictures of a doberdor, hound dog, a few rots, and my dog and asked if he could tell me the breeds and asked if he could tell me which ones could be my dog? I also showed him the paperwork saying she was a medium size mixed breed dog with a max weight of 38 pounds fully grown. He proceeds to just tell me that if they look like they could be part rot then they can be banned unless proven otherwise. I then asked him if being a service wasn't enough to keep her if I didn't have any other proof that she wasn't a rot because I had her trained to be my service dog and help me when I fall due to me having several surgeries and cases where I have fallen and struggled to get up if I am alone and he told me that being a service dog DID NOT exclude her from the breed ban and that I would need proof from where I got her or a Vet that said that she was another breed or that she wasn't part rot. Since then I have contacted several vets and where I got her and they haven't been able to help me disprove her being a rot without getting a DNA test done. We are still fighting to bring her home!

Q24. If a municipality has an ordinance that bans certain dog breeds, does the ban apply to service animals?
A. No. Municipalities that prohibit specific breeds of dogs must make an exception for a service animal of a prohibited breed, unless the dog poses a direct threat to the health or safety of others. Under the “direct threat” provisions of the ADA, local jurisdictions need to determine, on a case-by-case basis, whether a particular service animal can be excluded based on that particular animal’s actual behavior or history, but they may not exclude a service animal because of fears or generalizations about how an animal or breed might behave. It is important to note that breed restrictions differ significantly from jurisdiction to jurisdiction. In fact, some jurisdictions have no breed restrictions.
