二、立法必要性：
本市（省）现有大量伴侣动物与流浪动物，但现行法规对故意虐待、遗弃动物等行为缺乏明确、有效的法律责任规定，对流浪动物的人道管理亦无系统性规范。今年6月，广东揭阳发生的"旺旺"流浪母犬及其幼犬被未成年人虐待致死一案，即反映出这一法律空白所带来的现实后果，也引发了社会各界的广泛关注与讨论。制定本条例，有助于回应公众关切，完善城市治理体系。
三、法律依据：
本建议依据《中华人民共和国立法法》及本市（省）享有的地方立法权，属于社会治理、民生保障及生态文明建设范畴内的"小切口"立法。
四、拟解决的主要问题：
（一）故意及严重虐待伴侣动物、流浪动物的行为及其法律责任；
（二）遗弃伴侣动物及不负责任饲养行为的规制；
（三）流浪动物的人道化管理与保护；
（四）以营利为目的制作、传播虐待动物内容的行为及其处罚；
（五）未成年人实施严重虐待动物行为时的适当干预与教育机制；
（六）严重虐待动物行为应承担的法律责任。
五、说明：
本建议不要求制定国家层面的刑事立法（此非地方立法权限范围），而是恳请贵机关运用现有地方立法权，制定切实可行的地方性动物保护规范。
