CONTRADICTIONS IN DATES OF THE SUPPOSED FACTS A surprising game of question and answer, far from the subject that interested the judges. Talking about a meeting with the Islamologist, Henda Ayari says she started talking to Tariq Ramadan “in 2010." "I contacted him on Facebook. But when she recovered custody of her children, Henda Ayari believed she "did not have the need to exchange with Tariq Ramadan.” The meeting and the alleged rape, however, would take place after Henda Ayari has recovered custody of her children. The judge describes an exchange between Tariq Ramadan and Henda Ayari about a photo posted by the complainant on social media at the end of April 2012. He then points to "a contradiction between the estimated date of the facts and this text. Because Henda Ayari has always claimed to have been raped by Tariq Ramadan on the sidelines of the UOIF congress, ie. in early April of that year, "between March 31 and April 8" according to Henda Ayari’s former lawyers. She had also explained to the police that the exchange about this profile picture was dated "early 2012." A contradiction in the dates that surprised the judges, who have not yet focused on it. EIGHT HOURS OF HEARING, FIFTEEN QUESTIONS ON THE CASE This was followed by exchanges between the complainant and the judges about the time when Henda Ayari began to talk to Tariq Ramadan. Visiblement, les juges ont parfaitement lu le livre de Henda Ayari, « J’ai choisi d’être libre », qui a été ajouté au dossier d’instruction. Auditionnée ce 15 mai à Paris, après avoir refusé une confrontation avec Tariq Ramadan, Henda Ayari a été questionnée pendant toute une journée sur sa vie. Arrivée en milieu de matinée devant les juges, la plaignante a déroulé « son parcours de vie » et son « curriculum vitae », à la demande de la justice. Une audition que LeMuslimPost a pu consulter. Ainsi, Henda Ayari a décrit ses relations conflictuelles avec ses parents, ses frères mais aussi son ex-mari ou ses enfants. Une audition emaillée de pleurs à l’évocation de sa jeunesse. Henda Ayari a, pêle-mêle, rappelé que son ex-mari était devenu son « pire ennemi », évoqué l’existence, jusqu’alors cachée, d’une sœur qui était « comme sa fille » mais avec qui elle a finalement « rompu les liens », ou encore décrit quelques uns de ses « épisodes dépressifs » qui l’ont emmené jusque sur le canapé d’un psychologue. DES CONTRADICTIONS DANS LES DATES DES FAITS SUPPOSÉS Un jeu de questions-réponses étonnant, bien loin du sujet qui intéressait pourtant les juges. Il a fallu attendre la fin de la journée pour qu’un juge pose une toute première question sur l’affaire Tariq Ramadan. A propos d’une rencontre avec l’islamologue, Henda Ayari affirme avoir commencé à discuter avec ce dernier « en 2010. » « C’est moi qui l’ai contacté sur Facebook. Je cherchais des solutions pour aller mieux », explique la plaignante. Tariq Ramadan, continue-t-elle, « était comme un guide spirituel. » Mais lorsqu’elle récupère la garde de ses enfants, Henda Ayari estime avoir « moins l’utilité de discuter avec Tariq Ramadan. » La rencontre et le viol supposé auront cependant lieu après que Henda Ayari a récupéré la garde de ses enfants. Le juge décrit un échange entre Tariq Ramadan et Henda Ayari à propos d’une photo postée par la plaignante sur les réseaux sociaux fin avril 2012. Il pointe alors « une contradiction entre la date évaluée des faits et ce texto. » Car Henda Ayari a toujours affirmé avoir été violée par Tariq Ramadan en marge du congrès UOIF, soit au début du mois d’avril de cette année-là, « entre le 31 mars et le 8 avril » selon les anciens avocats de Henda Ayari. Elle avait également expliqué à la police que l’échange à propos de cette photo de profil datait de « début 2012. » Une contradiction dans les dates qui étonne les juges, qui ne se sont pourtant pas attardés sur celle-ci. HUIT HEURES D’AUDITION, QUINZE QUESTIONS SUR L’AFFAIRE S’en suivent des échanges entre la plaignante et le juge à propos du moment auquel Henda Ayari aurait commencé à tutoyer Tariq Ramadan. Les juges interrogent ensuite Henda Ayari sur ses propos auprès de la 2e DPJ le 25 octobre dernier : elle avait alors dit qu’elle s’attendait à « un moment romantique » en se rendant à ce rendez-vous avec Tariq Ramadan. « J’espérais peut-être que j’allais lui plaire », répond la plaignante. Dans une autre question consacrée à la personnalité de la plaignante, le juge fait remarquer à Henda Ayari qu’elle a affirmé « être séductrice » et que ceci est « aux antipodes » de la culture et de son rapport à la religion décrits précédemment. Henda Ayari évoque alors « un manque affectif important », avant de parler d’une psychanalyse. Après huit heures d’audition, les faits dont Henda Ayari accuse Tariq Ramadan n’auront été qu’abordés en surface, le juge ne posant qu’une quinzaine de questions sur l’affaire en elle-même.
