Tariq Ramadan’s closest friend and head of his support committee, Yamin Makri is one of France’s leading Muslim activists. Along with Mr. Ramadan he established the grassroots organization Muslim Presence in the 1990s and is one of the founders of Resistance and Alternative (https://www.facebook.com/resistancealternative/) This recently created movement brings together the Muslim networks from around the world that he has worked closely with for the last twenty years. Love him or hate him, Yamin Makri is difficult to ignore. In this interview, he breaks his media silence for the first time. MUSLIMPOST (MP): WHY ARE YOU SUPPORTING TARIQ RAMADAN? We are supporting Tariq Ramadan because we believe everyone has the right to a fair and equitable trial; it is abnormal for a man to be judged even before his trial has taken place. So, our first concern is the right to a basic Right; the right that underlies our commitment to harmonious co-existence. Nothing can be more fundamental. Second, we know the man intimately; the work he has done over the last thirty years, the values he stands for and defends. Despite the accusations leveled against him, we have full confidence in him, his moral qualities and his honesty. We are convinced of it. But, given the unfolding media frenzy, it is easy to understand that other people may come to different conclusions. Today, we are seeking one thing and one thing only: that justice be done in strict respect for established procedures, that it express itself and render its decisions in a clear and impartial manner. Tariq Ramadan is respected both within and outside the Muslim community. Our committee provides moral support for his family, and brings together those who are scandalized by the unjust treatment inflicted on him. Our committee rejects the double standard that has been applied to a man who is now being held in preventive detention while others, facing similar accusations, are free to walk the streets. MP: IS IT POSSIBLE THAT THE SUPPORT YOU ARE CALLING FOR MAY ENDANGER THE RESPECT AND THE RIGHTS OF THE PLAINTIFFS? DO YOU APPRECIATE THAT THEY, AND THE PUBLIC AT LARGE, MAY FEEL ILL AT EASE IN THE FACE OF SUCH BROAD SUPPORT? We fully respect the plaintiffs’ rights. They have the right to be heard, and no one is challenging that right. But today we see that Tariq Ramadan’s rights as an accused person are not being respected. In fact he has already been condemned. The plaintiffs, who are in fact “alleged victims,” are described by the media as “victims.” Tariq Ramadan, even though detained, remains innocent until proven otherwise, that is, until a guilty verdict is brought down. The most recent statement by a judge justifying continued preventive detention by “the risk that he may repeat his offenses” could not be clearer. For his judges, Tariq Ramadan is already guilty and has begun to serve his sentence without even having been judged. The situation is disturbing; we do not intend to let down our guard. Not only to ensure that Tariq Ramadan has a fair trial. What is at stake is preserving the very function of justice; respecting the principle of separation of powers. There is a sense that justice in this country no longer exists for certain kinds of people. MP: ONE HAS THE IMPRESSION THAT SOME ARE ATTACKING TARIQ RAMADAN BLINDLY, WHILE OTHERS DEFEND HIM UNCRITICALLY… IS THERE NOT A PROPER BALANCE? There’s no doubt that this affair has elicited a passionate response in the media, in society as a whole, and in the Muslim community. But the ‘Tariq Ramadan affair’ is also emblematic in terms of the significant role it has played in a society such as ours; a society that has extreme difficulty in coming to terms with difference and coexistence. The ‘Tariq Ramadan affair’ gained media attention following the international campaign against sexual abuse. Even though we believe that in the case of Tariq Ramadan this campaign has been manipulated and even hijacked, no one can contest its legitimacy. There can be no doubt that this same campaign has been used to bring down Tariq Ramadan. But we must not fall into the trap that has been set: we give it our full support. Movements calling for respect for the rights of women and for the rights of discriminated minorities must find common ground with those who defend the equality of citizens before the law. Every human being must be able to enjoy his or her Rights. Every human being must be respected. There can be no sub-humans here, in France, in Palestine, in the Sahel, or anywhere else in the world for that matter. A human life is a human life, irrespective of nationality, religion, sex or any other affiliation. The life of a migrant who drowns in the Mediterranean, of a young Syrian killed in a bombing, of a Palestinian imprisoned for protecting his land, or of a young Frenchman summarily executed during a concert in Paris: all these lives have equal value. All, in our eyes, are sacred. All of them have a claim on our attention; all of them demand that justice be served. Each of these ruined lives must cause us to think. They must make us aware that there is a serious problem in the way the world is managed. Turning against one another is no solution. Instead, we must establish more connections and build more bridges. Such was and always will be Tariq Ramadan’s struggle. We must protect and preserve our common humanity, the values we all share. The right to Rights is a fundamental one. Nothing can be more fundamental than the idea that we can come together as equal citizens around principles accepted by all. Women, like visible minorities, suffer daily from discriminatory behavior in their social and professional life. Sexism and all other forms of discrimination are evils that undermine the very notion of equality and non-discrimination for people with a different sexual, religious or racial identities. The ‘Tariq Ramadan affair’ has come to represent all these things. The court must decide, in full independence, on the guilt or innocence of the accused. But the procedures that guarantee impartiality must be respected. We ask for nothing more. If a double standard has been applied in this affair, the consequences will be far-reaching and incalculable. We will then transform Tariq Ramadan into a Swiss political prisoner held in a French prison. The door will then be open to the most extreme interpretations. As a French citizen, I am not prepared to allow my country to go down such a path, which would be catastrophic for all concerned. MP: HAVE THE RECENT REVELATIONS CONCERNING A FLIGHT RESERVATION WEAKENED TARIQ RAMADAN’S DEFENSE? THEY APPEAR TO BE A POWERFUL ARGUMENT FOR THE PROSECUTION. Not in the slightest. Tariq Ramadan has simply provided the necessary details to justify his schedule on that day. It is not surprising that a man who flies four or five times a week does not recall when he arrived in Lyon nine years earlier. Particularly when responding to invitations to participate in seminars or television appearances, he often changes or cancels a flight. He has provided the investigators with all the elements in his possession. It appears that the investigation has not been properly handled, either by Tariq Ramadan’s lawyers or by the judicial police. As a result this item, which simply constituted another element in the file (an airline reservation and not a ticket) became a key issue for the simple reason that it vanished from the file, only to reappear later. The leaders of the Union des Jeunes Musulmans in Lyon were able to clarify Tariq Ramadan’s schedule. In fact, he was in Lyon at the time claimed by the second plaintiff. This does not mean, however, that Tariq Ramadan is guilty. A simple flight reservation never constituted an alibi. But the absence of an alibi does not confirm guilt. Focusing on this reservation, which would never have proved anything had it existed, has diverted our attention from evidence that is much more problematic for the plaintiffs. In in particular there are indications of collusion with personalities recognized as Tariq Ramadan’s ideological adversaries. People such as Caroline Fourest, Gilles Kepel, Antoine Sfeir, Mr. Justice Debacq, Jean-Claude Elfassi, Ian Hamel, Alain Sorel, and Selim Laibi. How exactly are these ideologically biased individuals connected with the case? What is their interest in a matter that has been presented as a case of public morals? As of today, no credible explanation has been provided. It is only a matter of time before justice will be done. We are convinced of it. MP: WHAT IS YOUR RELATIONSHIP WITH TARIQ RAMADAN? DOES YOUR FRIENDSHIP WITH HIM NOT CLOUD YOUR JUDGMENT? I’ve known Tariq Ramadan since the late 1980s. We have worked and travelled together. We are very close. But I must add, having known the man for such a long time, that the dissonant elements in this case do not correspond at all with the person I know him to be. I speak not only of the accusations against him, but also of the “extras” that are foreign to the man and his widely known moral qualities. Tariq Ramadan is not the kind of man to impose the headscarf, nor to judge a woman who does not wear one. He is not the kind of man to insist that anyone swear to anything. The plaintiffs’ allegations are light-years away from what Tariq Ramadan is, stands for and professes. MP: WHAT ARE YOU EXPECTING FROM THE LEGAL SYSTEM; WHAT DO YOU THINK OF MEDIA TREATMENT OF HIS CASE? We must re-establish calm; we need fair and equitable justice, free from media influence. The facts must be judged. Not someone’s way of thinking. MP: HAS THIS AFFAIR DIVIDED OR UNITED THE MUSLIM COMMUNITY? People, whether they’re Muslims or not, are not stupid. They can see that a double standard exists. Unfortunately, this is not something new in our country. A host of other considerations make this affair a particularly sensitive one in the eyes of the public: there have been multiple denunciations of sexual abuse against high-ranking political personalities. The media frenzy coupled with Tariq Ramadan as a symbol in the public eye, as well as the critical situation in the Middle East, only add to the tension. Not to mention the government’s declared intention to once again reorganize Islam in France. But none of this has been able to stop repeated displays of solidarity, support and messages of affection, which we are deeply thankful for. All of this has been an immense comfort for his family and friends in this time of trial. More than 120,000 individuals have signed our petition, a remarkable achievement given the media offensive that has targeted us since the affair came to light. Our call for donations to support our legal expenses was far more successful than we could have imagined. Now, as men and women of faith, we know that this trial has a meaning, and that justice will have the last word. Tariq, his family and all those who support him are enduring extremely difficult times. But truth will out; we are convinced of it. The people of Truth and Justice will emerge all the greater. For, lest we be misunderstood, more than defending a man who is very dear to us, we are defending the shared values that make us who we are. MP: WHAT CAN YOU TELL US ABOUT THE STATE OF TARIQ RAMADAN’S HEALTH? We are deeply concerned. We know that Tariq is doing very poorly. He is losing feeling in his lower limbs and is experiencing intense pain. The judges have ruled that his illness does not justify his release. But he has twice been admitted to hospital on an emergency basis in fewer than 15 days. We do not understand the reasoning of the judges. What could possibly explain their relentless prosecution? If he is not given proper care his life may well be at risk. The consequences would be tragic for all concerned. MP: IF THERE WERE ONE THING YOU WOULD LIKE PEOPLE TO KNOW, WHAT WOULD IT BE? All we want is objectivity, common sense and foresight. These are the conditions needed for truth and justice to prevail in an atmosphere of calm. Whatever people might say, and think, Tariq Ramadan has the right to fair and equitable treatment. He presented himself on that infamous January 31 in Paris with total confidence in the legal system. Neither he nor any of us thought for a moment that preventive detention was a possibility. It was a brutal blow for his family, his friends, and more all those who support him. In spite of everything, we remain confident. We are committed to the values in which we believe, to the Muslim community that trusts us, and to the society we belong to. We are committed to living together in harmony, to defending justice, legality and truth, in France and around the world. Whatever the outcome of Tariq’s case, we will continue to stand side by side with the Just and to strive to make our voices heard, and not to allow our country to abandon itself to the aberrations of a bygone age. Yamin Makri : Nous soutenons Tariq Ramadan parce que nous pensons que tout le monde a droit à un procès équitable, qu’il n’est pas normal qu’un homme soit jugé avant même qu’un procès ait lieu. C’est donc avant tout une question de droit au Droit. C’est ce qui fonde notre volonté de vivre ensemble. C’est fondamental. Ensuite, nous connaissons profondément l’homme, le travail qu’il a accompli depuis trente ans, les valeurs qu’il prône et qu’il défend. Et, malgré toutes les accusations qui sont portées contre lui, nous avons une totale confiance en lui, en ses qualités morales et en son honnêteté. C’est notre conviction. Mais, vu le matraquage médiatique, il est compréhensible que d’autres personnes pensent différemment. Aujourd’hui, nous ne désirons qu’une seule chose : l’application d’une justice dans le respect strict de ses procédures, elle doit s’exprimer et rendre ses décisions de manière claire et impartiale. Tariq Ramadan est respecté aussi bien à l’intérieur qu’à l’extérieur de la communauté musulmane. Le comité apporte un soutien moral à la famille, il rassemble les gens scandalisés par le traitement injuste infligé à Tariq Ramadan. Ce comité dénonce le deux poids deux mesures qui est fait envers un homme qui est mis en détention provisoire quand d’autres, pour des faits au moins similaires, sont en liberté. LE SOUTIEN QUE VOUS APPELEZ À APPORTER NE RISQUE-T-IL PAS D’ENTRAVER LE RESPECT ET LE DROIT DES PLAIGNANTES ? COMPRENEZ-VOUS QUE LES PLAIGNANTES ET LE PUBLIC PUISSENT ÊTRE MAL À L’AISE VIS-À-VIS DE CE TRÈS LARGE SOUTIEN ? Nous respectons totalement le droit des plaignantes. Elles ont le droit d’être entendues. C’est un postulat que nul ne remettra en question. Aujourd’hui, ce que nous constatons, c’est que les droits de Tariq Ramadan en tant qu’accusé ne sont pas respectés et qu’il est déjà considéré comme coupable. Les plaignantes, qui ne sont pour l’instant que des « présumés victimes », sont déjà décrites par tous les médias comme des « victimes ». Et Tariq Ramadan, le prévenu, qui reste innocent sauf preuve du contraire, c’est-à-dire jusqu’à une décision de justice, est décrit comme un coupable évident. La dernière déclaration du juge qui justifie sa détention préventive pour des risques « de réitération des faits » est très claire. Pour ces juges, Tariq Ramadan est déjà coupable et il a déjà commencé à purger sa peine sans même être jugé. C’est très inquiétant mais nous ne baisserons pas les bras. Pas seulement pour que Tariq Ramadan ait droit à une justice équitable. L’enjeu est bien plus important que cela : il s’agit ici de préserver l’instance judiciaire, que la séparation des pouvoirs soit respectée et que ne persiste pas dans mon pays le sentiment que la justice n’existe plus dès qu’elle concerne un certain type de population. ON A L’IMPRESSION QUE LES UNS ATTAQUENT AVEUGLÉMENT TARIQ RAMADAN PENDANT QUE D’AUTRES LE DÉFENDENT SANS DISCERNEMENT… N’Y A-T-IL PAS UN JUSTE MILIEU ? Il est clair que cette affaire suscite trop de passions dans les médias, dans la société, et dans la communauté musulmane. Mais l’affaire Tariq Ramadan est emblématique. C’est une affaire qui est lourde de sens dans notre société qui a beaucoup de mal à gérer les différences et le vivre-ensemble. L’affaire Tariq Ramadan a été médiatisée dans le cadre de la campagne mondiale contre les abus sexuels. Si, pour notre part, on considère que dans le cas de l’affaire Tariq Ramadan, il y a une instrumentalisation et un détournement de cette campagne, cela n’enlève rien à sa légitimité. On a certes usé de cette campagne pour faire tomber Tariq Ramadan mais nous ne tomberons pas dans le piège tendu : nous apportons notre total soutien à cette campagne. Les mouvements appelant au respect des droits des femmes et ceux qui appellent au droit des minorités discriminées doivent se retrouver avec tous ceux qui défendent une citoyenneté égalitaire. Tout être humain a droit au Droit. Tout être humain doit être respecté. Il n’y a pas de sous-être Ici, en France, mais aussi en Palestine, au Sahel et dans le monde entier. Une vie humaine est une vie humaine quelle que soit sa nationalité, sa religion et au-delà de son sexe et de tous types d’appartenances. La vie d’un migrant qui se noie en Méditerranée, celle d’un jeune syrien tué lors d’un bombardement, celle d’un Palestinien emprisonné parce qu’il protège sa terre ou celle d’un jeune français sommairement exécuté pendant un concert à Paris, toutes ces vies sont d’égale importance. Elles sont toutes sacrées, à nos yeux. Toutes réclament notre attention, toutes exigent que justice soit rendue. Toutes ces vies fauchées doivent nous interroger. Elles doivent nous faire prendre conscience qu’il y a un véritable problème dans la manière dont le monde est géré. Et nous ne trouverons aucune solution en nous dressant les uns contre les autres. Tout au contraire, il faut multiplier les liens, créer des ponts. C’était et c’est toujours tout le combat de Tariq Ramadan. Il faut préserver notre humanité commune, nos valeurs communes et nous en avons. Le droit au Droit est fondamental, cette idée de croire qu’on peut se retrouver sur la base d’une citoyenneté égalitaire et d’un socle qui nous rassemble est tout autant fondamental. Les femmes comme les minorités visibles souffrent au quotidien de comportements discriminatoires dans leur vie sociale et professionnelle. Le sexisme et toutes les autres discriminations sont des fléaux qui remettent en cause la notion même d’égalité et de non-discrimination face à une appartenance sexuelle, religieuse ou raciale. L’affaire Tariq Ramadan est emblématique de tout cela. La justice devra décider en toute indépendance de la culpabilité ou non de l’accusé. Mais les procédures et l’impartialité doivent être respectées. C’est notre seule revendication. S’il y a un deux poids deux mesures qui est appliqué sur cette affaire, les conséquences seront profondes et incalculables. Nous transformerons alors Tariq Ramadan en un détenu politique suisse enfermé dans une prison française. Ce sera la porte ouverte à toutes les voies extrêmes. En tant que citoyen français, je ne laisserai pas mon pays s’engager dans cette voie catastrophique pour nous tous. A PROPOS DES RÉVÉLATIONS DE LA RÉSERVATION D’AVION, CELA FRAGILISE-T-IL LA DÉFENSE DE TARIQ RAMADAN ? CELA SEMBLE ÊTRE UN ARGUMENT À CHARGE DE POIDS. En aucun cas. Tariq Ramadan n’a fait que fournir les éléments qu’il avait en sa possession pour justifier de son emploi du temps de la journée en question. Il est logique qu’un homme qui prend l’avion quatre à cinq fois par semaine ne se rappelle pas de l’heure à laquelle il est arrivé à Lyon neuf années plus tôt. Surtout qu’au gré des invitations à des séminaires ou à des émissions télé, il lui arrivait très souvent de modifier ou d’annuler un déplacement. Il a fourni tous les éléments en sa possession. Il s’avère que le travail d’investigation n’avait pas été fait de manière correcte, ni par l’avocat de Tariq Ramadan, ni par les enquêteurs de la police judiciaire. Or, voilà que cette pièce, qui n’était qu’un élément du dossier (une simple réservation et non pas un billet), devient centrale par le fait étrange qu’elle disparaisse du dossier pour réapparaître. Les responsables de l’Union des Jeunes Musulmans à Lyon ont permis de faire la lumière sur l’emploi du temps de Tariq Ramadan et, effectivement, il était à Lyon à l’heure des faits que la seconde plaignante apporte, mais cela ne signifie en aucune manière que Tariq Ramadan soit coupable pour autant. Une simple réservation d’avion n’a jamais été un alibi. Et une absence d’alibi ne fait pas de vous un coupable. Le fait d’avoir concentré les esprits sur cette réservation, qui ne prouve rien même si elle existait, a permis de nous écarter des éléments du dossier beaucoup plus problématique pour les plaignantes. Et, en particulier, sur des indices manifestes de collusion avec des personnalités reconnues comme des ennemis idéologiques de Tariq Ramadan tels que Caroline Fourest, Gilles Kepel, Antoine Sfeir, le juge Debacq, Jean-Claude Elfassi, Ian Hamel, Alain Soral, Selim Laibi. Que viennent faire toutes ces personnes très marquées idéologiquement et citées dans le dossier ? Que viennent-elles faire dans une affaire présentée comme une affaire de mœurs ? Jusqu’à aujourd’hui, on ne nous a fourni aucune explication crédible. La justice statuera, nous en sommes convaincus, ce n’est qu’une question de temps. QUELLE EST VOTRE RELATION À TARIQ RAMADAN ? VOTRE AMITIÉ N’ALTÈRE-T-ELLE PAS VOTRE JUGEMENT? Je connais Tariq Ramadan depuis la fin des années 80. Nous avons travaillé et voyagé ensemble. Nous sommes proches effectivement. Mais, pour avoir côtoyé l’homme depuis si longtemps, je peux affirmer que des éléments dissonants de l’affaire ne cadrent en rien avec la personne qu’il est. Et je ne parle pas des faits dont on l’accuse. Je parle de tous ces « à côté » qui ne cadrent pas du tout avec l’homme et toutes ses qualités morales connus de tous. Tariq Ramadan n’est pas un homme qui va imposer le voile, ni juger une femme parce qu’elle ne le porte pas. Il n’est pas homme à demander à quiconque de prêter serment à quoi que ce soit. Le récit des plaignantes est totalement à des années-lumière de ce que Tariq Ramadan est, promeut et défend. QU’ATTENDEZ-VOUS DE LA JUSTICE AUJOURD’HUI ET QUE PENSEZ-VOUS DU TRAITEMENT MÉDIATIQUE DE L’AFFAIRE ? Il faut rétablir de la sérénité, il nous faut une justice équitable libérée de toute influence médiatique. Il faut juger des faits, rien que des faits. Pas une pensée. EST-CE QUE CETTE AFFAIRE A DIVISÉ OU AU CONTRAIRE SOUDÉ LA COMMUNAUTÉ MUSULMANE ? Les gens, musulmans ou non, ne sont pas dupes. Ils voient qu’il existe un deux poids deux mesures. Cela n’est malheureusement pas nouveau dans notre pays. Mais de nombreux autres facteurs rendent cette affaire extrêmement sensible aux yeux du grand public : les multiples dénonciations d’abus sexuels à l’encontre de personnalités politiques de haut rang qui se multiplient, la surmédiatisation et le symbole que représente Tariq Ramadan qui concentre toutes les attentions, le contexte difficile au Moyen-Orient qui rajoute à la tension, cette volonté politique de vouloir une nouvelle fois réorganiser l’islam de France dans ce contexte qui interroge. Mais tout cela n’a pas été un frein à l’expression d’une solidarité impressionnante, des soutiens et des marques d’affection pour lesquels nous sommes très reconnaissants. Il est réconfortant pour la famille et les amis de recevoir toute cette empathie en ces temps de lourde épreuve. Notre pétition a reçu plus d’une centaine de milliers de signataires, ce qui est remarquable dans le contexte d’une campagne médiatique que nous subissons depuis le début de cette affaire. L’appel aux dons pour soutenir les frais de justice a reçu un vif succès au-delà de tout ce qu’on pouvait imaginer. Maintenant, en tant qu’êtres de foi, nous savons que cette épreuve a un sens et que la justice finira par se prononcer. Tariq, sa famille et tous ceux qui les soutiennent vivent des moments très difficiles. Mais, la vérité reprendra sa place, nous en sommes convaincus. Et les Hommes de vérité, les Justes en sortiront grandis. Car, comprenons-nous bien, avant de défendre un homme que nous aimons, nous défendons des valeurs communes qui nous constituent. QUE SAVEZ-VOUS DE L’ÉTAT DE SANTÉ DE TARIQ RAMADAN AUJOURD’HUI ? Nous sommes inquiets. Nous savons que Tariq va très mal. Il perd la sensibilité de ses membres inférieurs et souffre de douleurs importantes. Les juges ont décidé que sa maladie ne justifiait pas sa libération. Mais il a été hospitalisé en urgence deux fois en moins de 15 jours. Nous ne comprenons pas la décision des juges. Qu’est-ce qui motive cet acharnement ? S’il n’est pas soigné correctement, sa vie peut très vite être mise en danger. Les conséquences en seraient dramatiques pour tout le monde. S’IL Y A UNE CHOSE QUE VOUS VOUDRIEZ QUE LES GENS SACHENT SUR CETTE AFFAIRE, QUELLE SERAIT-ELLE ? Nous voulons simplement de l’objectivité, du sens et de la clairvoyance. Ce sont les conditions de la vérité et d’une justice saine. Quoi qu’on en dise et quoi qu’on en pense, Tariq Ramadan a le droit de bénéficier d’un traitement équitable. Il s’est rendu ce fameux 31 janvier à Paris avec une confiance totale en la justice. Ni lui ni nous n’avons pensé que l’éventualité d’une détention provisoire était possible. C’est un coup dur pour sa famille, pour nous ses proches, et pour l’ensemble des gens qui le soutiennent. Mais nous sommes confiants, malgré tout. Nous avons un engagement envers les valeurs auxquelles nous croyons, envers la communauté musulmane qui nous fait confiance et envers la société auquelle nous appartenons. Cet engagement est celui de promouvoir le vivre-ensemble, de défendre la justice, le droit et la vérité en France et dans le monde. Quelle que soit l’issue de l’affaire de Tariq, nous continuerons avec tous les Justes à œuvrer et à nous exprimer sans relâche pour ne pas laisser notre pays s’abandonner à des déviances d’une autre époque.
