It's over and unimaginably worse than we expected

Thank you all for your reasonableness and support of justice. Unfortunately, that fight ended today; and not in our favor. Our community is markedly less safe. 

Today, Husayn Braveheart, murderer of Steve Markey, accepted a plea deal pleading guilty to attempted assault. He was given the presumptive sentence which is 54 months in prison. Prisoners typically serve about 2/3 of a sentence behind bars and the rest on supervised release. With credit for the time he has already served, Braveheart could be released as soon as Monday.
 
The first deal presented was for a charge of second-degree murder with a proposed sentence of probation. Since probation was a downward departure from the sentencing guidelines, the judge had to agree with and approve that plea deal. In today's deal, the defense and prosecution agreed to it and to follow the sentencing guidelines. This effectively tied the judge's hands and he was unable to do more than accept the deal.
 
The judge said he was disappointed in the treatment our family has received. He expressed strong misgivings about this sentence and Mr. Braveheart's ability to keep himself out of trouble. The judge expressed concerns that this was not in the interest of public safety.
 
However, since the prosecution sunk to a new low and was working in concert with the defense, there was nothing that could be done. Our family is stunned and shocked and extremely sad and fearful. This is in no way justice and it is as disappointing as it is disturbing. Unfortunately, this is not the last case that will be decided this way. 
 
Mary Moriarty has just begun her term as Hennepin County Attorney and is just beginning to implement her brand of justice reform. In addition to allowing people to plead guilty to grossly reduced charges, she's also declining to charge cases as well. Just recently she declined to charge the man who dragged a Maple Grove police officer more than 400 yards while attempting to flee a traffic stop.

Hennepin County Attorney Mary Moriarty actively injured our family and is systematically making our community less safe every day

I wish I had good news, but I don't. Things are not going in the right direction and we are at the beginning of Mary Moriarty's term.
