Petition updateJustice for EleanorMisleading response from the Attorney General's Office

It has come to my attention that those who have emailed Lord Hermer, including those on my WhatsApp group, have received automated replies which state:-

Please note that, although the Attorney General superintends the Crown Prosecution Service (CPS), Serious Fraud Office (SFO), and Government Legal Department (GLD), these departments are operationally independent and the Attorney General’s Office is unable to intervene in individual cases or comment on any active proceeding

Please do not be disheartened by this; it is both misleading and inaccurate

I have now amended my website to give greater weight to the Attorney General's Press Release dated 26th June 2018. This Press Release, insensitively issued on the day that would have been Eleanor's 28th Birthday (had she been alive!), states that the Attorney General will not be ordering a Public Inquiry into the CPS. The Attorney General considered the CPS ‘marking its own homework’ i.e. Dame Alison’s internal review, to be satisfactory inquiry!

How can the Attorney General be ‘unable to intervene’ when he has issued a Press Release showing that he was considering exercising his powers to do so?

Let me provide further detail,

We reengaged with the Attorney General, regarding a Public Inquiry, after my successful Public Interest defence to the Libel Claim made against me by Alexander Economou. The Attorney General proposed a course of action to enable him to make a decision, which seemed perfectly reasonable to us.

-        Firstly, he was going to write to both the Coroner and the Director of Public Prosecutions (Dame Alison Saunders) and ask them whether they felt a Public Inquiry was necessary.

-        Secondly, he was going to forward their responses to us for our comments.

-        Finally, he would consider all the submissions, and decide.

We heard from the Coroner pretty much within the timescale requested by the Attorney General. Dame Alison took the better part of a year. When we did hear from her, she placed great reliance on the document I am now gagged on, which I term NMAN. I only got access to NMAN after the Attorney General, Sir Jeremy Wright, had refused our call for a Public Inquiry, and even then, only after we had threatened a Judicial Review.

Given the above procedure, I do not see how the Attorney General's Office can issue automated emails saying that the Attorney General doesn't get involved?

You might like to contrast this with the conduct of the Coroner, who is definitely not under the superintendence of the Attorney General, who had little difficulty cooperating with this fair process. Given that it serves the interests of justice, why wouldn’t he cooperate?

Both the Coroner and Dame Alison did not support our call for a Public Inquiry. I wonder whether the Coroner would maintain that view if he saw the contents of NMAN?

It is fact that the CPS declined our suggestion to become an 'Interested Party' in Eleanor's Inquest. This would have provided an excellent opportunity for the CPS to reassure all women who need to report rape, that they need not fear doing so as the CPS's procedures are ok.

May I suggest that all of you who have written to Lord Hermer and received an automated response with the above wording respond in writing along the following lines.

Dear Lord Hermer,

I have received your automated response to my emailed letter calling for a Public Inquiry of the CPS's decision to continue Alexander Economou’s Private Prosecution against Eleanor de Freitas for allegedly lying about her rape allegation against him, and to remove the Gagging Order against her father. Given the Press Release dated 26th June 2018, issued by your predecessor, Sir Jeremy Wright, this is clearly misleading for the reasons given in the first update of the petition on Change.org JusticeForEleanor  https://chng.it/CYhWnt9FXH

If you still refuse to answer my original request, please advise me of your complaints procedure.

Yours sincerely,

Your name (and address if you are posting this)

To avoid a repetition of the same auto-misresponse, it may be an idea to post this to: Lord Hermer, Attorney General, Attorney General’s Office, 102, Petty France, London SW1H 9EA
