What is an evidentiary hearing?
A motion to set an evidentiary hearing in an Oklahoma post-conviction relief case serves to present new evidence and testimony to resolve factual issues that were not previously presented in the original trial. The purpose is to argue that the conviction or sentence should be vacated because of these "material facts not previously presented," such as claims of ineffective assistance of counsel.
