Justice Delayed is Justice Denied
Dear Justice For Jenny Supporters,
According to Professors Tania Sourdin's and Naomi Burstyner's article, "William E Gladstone, Former British Statesman and Prime Minister in the late 1800’s, famously said ‘justice delayed is justice denied’". It's a statement that has been uttered many times in history. I first saw this quote when passing a city courthouse one day, not long after my daughter and her unborn baby's murder. In fact, I, and others following this case, have quoted this many times throughout this very long process; a process that has been historically arduous and flawed.
This case has been consistently extended for reasons that can be interpreted by the layperson as petty. But if you take a look at the criminal justice system case flow chart [attached as hyperlink], it begins to come to light that this is quite the norm. The initial process goes by pretty quickly, actually. But once you get past the adjudication process, that's when you get stuck in what I call the criminal justice twilight zone. You can get stuck here for months. In fact, this is where we have been for several months now. It's just how it goes. I'd like to point out that this petition is not about delaying the case because of COVID. It's about the case itself, and justice being delayed because of a systemic problem. It just so happens that COVID came along and exasperated an issue that was already there.
I'm sure you'd all like to know the status of the situation, and here it is: If you're following the case, you will note that the next court date is not until September 14th, 2020. Apparently, since the court system is closed until then, it's a mute point to even ask the defense to comply with the discovery reform law protocol to submit the documentation it was supposed to have submitted months ago. Why should they have to do that since the courts are closed anyway, right? WRONG! But that's what has happened. In essence, nothing will happen with the case until September, and we literally have no say in this. Coincidentally, we are right on schedule according to the criminal justice system timeline. By September, it will be 19 months. And in September, we don't even know what will happen. And although it seems a mute point to do so, this petition will remain open because of that.
