Stop employers from screening for Marijuana in the State of Michigan.

The Issue

Employers within the State of Michigan should not be allowed to have employees take drug tests that test for Marijuana (THC) since Marijuana is now recreationally legal for citizens age 21 and older. If the employee is not breaking the law by smoking Marijuana or using Marijuana products, there is no reason to test for it (via drug, hair, or blood samples). A test that is used to determine toxicity at the time of testing, and up to several hours beforehand would be more appropriate to subject employees to. Being under the influence of Marijuana while at work is something the employer should determine the punishment for, if there are any. This more accurate and time-sensitive type of test should be required at the time of an incident or reasonable suspicion while on the job. Until such a test exists and is being used by employers in the State of Michigan, drug screening for Marijuana (THC) should be banned. Screening for a legal substance that employers can use while not at work, and not come to work under the influence of, is invading employees' private lives. Most alcohol screenings used at workplaces are able to tell the intoxication of an individual at the moment of screening, but not the last several days or even the night before. Marijuana users should be subject to the same type of testing, not a more intrusive test. 

If testing should still continue to happen, termination or discrimination against employees who use Marijuana or Marijuana products should be illegal. 

Marijuana (THC) is now a legal substance in the State of Michigan that should be treated as such. Many people use Marijuana for their own reasons and should be allowed to do so by all employers outside of the workplace. People can keep their jobs, as long as they're being responsible and not going to work under the influence of Marijuana, and enjoy the freedoms us citizens have voted for. A more accurate and shorter-term test would allow this, a test that can determine levels of THC toxicity at the time of testing and several hours prior is what needs to be created. This would allow employers to take action against employees coming to work under the influence of Marijuana, and would also allow employees to use Marijuana and Marijuana products outside of work, and not at the workplace. 

We create these laws and support these laws to be able to live our lives according to said laws. The current drug screening done by employers bars us from being able to enjoy the new Marijuana laws us citizens have voted for. Drug screening for Marijuana (THC) needs to be banned until a new test is devised.
