There is no doubt about the fact that the third pillar of our Indian democracy, that is the Judiciary is under threat from a certain lobby of lawyers and activists who can browbeat our honorable Judges to act as per their whims and fancies. If not, they will scandalize the Court, character assassinate respected Judges or cause hindrance towards the administration of justice in India. Honorable former CJI Mr. Dipak Mishra was also a victim to the same lobby. When an order wasn’t given in favor of Mr.Prashant Bhushan, Honorable CJI Dipak Mishra was at the receiving end of baseless allegations against him. In later months, he was subjected to an impeachment proceeding despite the fact that there was no tangible evidence against him and nor were there the requisite numbers in the Parliament to make impeachment proceedings reach a conclusive end. The Honorable Vice President of India later dismissed it based on a pragmatic analysis of the entire situation. Later, Mr.Prashant Bhushan’s lobby appealed to the Honorable Supreme Court of India, which, after a careful analysis of legal principles, dismissed their claims. Many knew that these impeachment proceedings were initiated, because a 3-judge bench consisting of Honorable CJI Dipak Mishra, Honorable Justices DY Chandrachud and AM Khanwilkar did not find merit in the PIL demanding investigation in the death of late Honorable Judge Loya.
Later on, when Honorable Justice Ranjan Gogoi became CJI, he also faced similar attacks from a section of lawyers as he did not give favorable order in cases like Rohingya deportation. Even though there were attempts to lower the image of the office of Honorable CJI before the public by levying baseless allegations of sexual harassment, our Honorable Supreme Court of India was kind enough to order an investigation by the Honorable Judges of the Supreme Court to inquire into the matter. Upon a careful analysis of facts and law when they pronounced their judgment, they were again subjected to vilified attacks.
Our incumbent Honorable CJI Sharad Arvind Bobde has been subject to personal attacks by Mr.Prashant Bhushan. Despite working hard and tirelessly amidst a pandemic to deliver justice, he was subjected to baseless attacks by Mr.Prashant Bhushan which not only scandalized the court but also caused obstacles in delivering justice. If he does not give positive relief to the lobby led by Mr.Prashant Bhushan, then he will be vilified, seems to be the bottom-line. Even a photograph of him sitting on a motionless standing motorcycle was released in public, firstly in violation of his fundamental right to privacy. Later, to harm his dignity and reputation, further attacks were made that he was not wearing a helmet; or not doing his job as a Judge, devoid of the fact that he was merely posing during his personal leisure time (which is a part of his privacy). Secondly, everyone knew that our Honorable Supreme Court worked tirelessly through virtual hearings to dispense Justice even during the lockdown.
On a Contempt Petition by a young public spirited lawyer Mr. Mahek Maheshwari from Guna (Madhya Pradesh), the Honorable Supreme Court of India decided to convert it into a suo moto case of contempt, as the very institutional integrity of our Judiciary was at stake in the matter. Recently, some people, who previously have held Public Offices and are known for their support to anti-national forces, signed a letter in support of Mr.Prashant Bhushan without giving a thought to provisions of our Contempt Law! It is surprising that only very few lawyers have signed it as they know very well about our Contempt Law. Surprising is the fact that Mr.Prashant Bhushan's father Shri Shanti Bhushan and his brother Shri Jayant Bhushan, who is a senior advocate, did not sign it!
This is not first time that Mr.Prashant Bhushan has committed such an act. In 2019, the respected Attorney General of India Shri KK Venugopal also initiated contempt proceedings against him for his tweets on Rafael issue. A decade ago, he made similar attempts to defame former Honorable CJI SH Kapadia, who is unfortunately no more in this world. As a result, former Solicitor General of India Mr. Harish Salve intimated contempt proceedings against Mr.Prashant Bhushan which is still pending. Recently, when it got listed before the Honorable Supreme Court, the counsels for Mr.Prashant Bhushan asked to further delay the matter.
In a 2009 interview, Mr.Prashant Bhushan alleged that at least half of the 16 former Chief Justices in the Supreme Court were corrupt. Even a most respected Justice of India, former Justice V Krishna Iyer said that he should be punished for such remarks against the top judiciary. And also, he has openly led support to Naxalites, Maoists and various other anti-India forces. He even advocated the secession of Kashmir from India openly. There are ample evidences in public about how he thwarted laws to illegally get land in Noida, UP.
In the interest of upholding the institutional integrity of the Honorable Supreme Court of India, we the citizens of India strongly condemn Mr.Prashant Bhushan in his attempts to scandalize our respected Judiciary for personal political gains.
