Stop the deportation of Oswaldo Martinez

Oswaldo Martinez is the loving husband of his U.S. Citizen wife, Leticia, and U.S. Citizen daughter, Alexandra, who is 10 years old. Oswaldo has been mandatorily detained in immigration detention for 10 months and he has now been denied withholding of removal (a form of protection similar to asylum) by an Immigration Judge.

We are calling on Immigration and Customs Enforcement (ICE) to exercise prosecutorial discretion and administratively close Oswaldo's case so he can remain living in the U.S. and support his family.

Oswaldo's wife, Leticia, is disabled, as she is blind in one eye. She has experienced health issues recently requiring major surgery. She is also experiencing a health crisis currently, facing a potential cancer diagnosis and the development of cataracts in her good eye. For the last 10 months, she has struggled financially with the loss of Oswaldo's income and care-taking support. Alexandra has also suffered greatly with the loss of her father, the fear that he may be deported, and the idea that their family may be permanently separated.

Oswaldo has lived in the U.S. since he was a teenager. He was taken into ICE custody last year after a recent interaction with the criminal justice system for something he did when he was very young. He is now 41 years old and facing deportation to a country he barely knows because of past misdemeanors from 2002-- 15 years ago.

We urge ICE to consider the burden and cost of Oswaldo's deportation on his family and broader community. He does not represent a danger to anyone.
