Dear Apartment Owners,

We need your support for the statewide movement to Amend the Maharashtra Apartment Ownership Act 1970. ( MAOA 1970 )

After the meeting of members of Akhil Bhartiya Grahak Panchayat, Maharashtra Societies Welfare Association, Pune Citizen Forums, PCMC Hsg Federation & Flat Buyers Group with MLA Shri Atul Bahatkalkar, we have decided to send the appeal letters of all the apartment complexes demanding amendment of the MAO Act 1970

The draft appeal to amend the MAO Act ( in Marathi and English ) is attached as below.

Help required from you

  • Please print the draft format on your complex letterhead ( you may edit and add your specific issues if required ) and get it signed by office bearers.
  • If your complex is not registered, please create a letterhead like "XYZ Housing Complex proposed" and sign it from the President /Secretary of the AdHoc committee.
  • Once signed, scan the document. The scanned JPEG or PDF file to be emailed to cm@maharahstra.gov.in and chiefminister@maharashtra.gov.in with a CC to amendapartmentact1970@gmail.com.

महाराष्ट्र वेश्म मालकी अधिनियम १९७० (The Maharashtra Apartment Ownership Act, १९७०) या विधेयकाचा बिल्डर / विकासकाने जो अनैतिक आणि अवैधानिक गैर फायदा स्वार्थी वृत्तीने घेतला आहे त्यामुळे आम्ही त्रस्त आहोत, आणि आमचा गृहनिर्माण सोसायटी स्थापनेचा मूलभूत अधिकार हिरावला गेला आहे.

ग्राहकांची फसवणूक टाळण्यासाठी तसेच मूलभत अधिकारांचे जतन करण्यासाठी सदर कायद्यात खालील सुधारणा त्वरित करावी हि विनंती:

1)     हा कायदा ९ सदनिकांपर्यंतच सीमित करावा, तसेच ९ पेक्षा जास्त सदनिका साठी महाराष्ट्र कॉपरेटिव्ह सोसाटीज अक्ट, १९६० (Maharashtra Co-operative Societies Act, 1960) लागू करण्यात यावा.

2)     डीड ऑफ डिकलरेशन एकतर्फी न करता, ग्राहकांच्या बहुमताने करण्याची तरतूद करावी.

3)     प्रत्येकाचे वेगळे वेगळे अपार्टमेंट डीड न करता सहकारी गृहनिर्माण संकुलाचे खरेदी खत होते त्याच प्रमाणे सर्वांचें एकत्रित मालकी हक्क तबदील करण्याची करावी.

4)     अपार्टमेंट च्या जागेचे मालकी हक्क सुलभरीत्या तबदील करण्यासाठी सोसायटी अक्ट सारखीच डीम्ड अपार्टमेंट ची तरतूद कायदयात करावी.

5)     सध्या जे कॉंडोमिनिम किंवा असोसिएशन ऑफ अपार्टमेन्ट गृहसंकुल आहेत, त्यांना कॉपरेटिव्ह हौसिंग सोसायटी म्हणून नव्याने नोंदणी करण्याची तरतूद करण्यात यावी.

6)     अपार्टमेंट ते सोसायटी च्या नावे गृहसंकुल तबदील करण्यासाठी कोणतीही स्टॅम्प ड्युटी आकारली जाऊ नये अशी तरतूद करावी.

तरी वरील प्रमाणे अपार्टमेंट अक्ट मध्ये बदल करून ग्राहकांना दिलासा देऊन त्यांना त्यांचे मालकी हक्क प्रदान करावेत, ही विनंती.

Subject: Immediate repeal and/or amendments in the Maharashtra Apartment Ownership Act, 1970 reg…..

Dear Shri. Devendra ji,

We the flat owners are frustrated due to unethical and illegal misuse of the Maharashtra Apartment Ownership Act, 1970 by the builder / developers for their economic and professional gains at the cost of our investment. Most significantly it has deprived us of our constitutionaly awarded fundamental right of registering and managing a Cooperative Housing Society.

In order to arrest any further losses to the real estate consumers and to protect fundamental rights we request you to amend this law as noted below.

1.      Jurisdiction of this law be restricted to the buildings or complexes of less than 9 flats. Complexes or buildings with more than 9 flats must be under the jurisdiction of the Maharashtra Co-operative Societies Act, 1960.

2.     Unilateral registration of Deed of Declaration be stopped forthwith, and it must happen following majority decision by the flat owners.

3.     Practice of registering separate Apartment Deed for each flat-owners, similar to the Sales Deed for the Cooperative Housing Complexes, a unified transfer of ownership rights be affected.

4.     In order to facilitate transfer of ownership of the complex, similar to the Societies Act; Deemed Apartment process be adopted for Apartment complexes as well.

5.     Establish a process by which existing Apartment complexes can convert itself into a Cooperative Housing Society.

6.     Ensure that no fresh stamp duty is levied while transition of existing Apartments into the Cooperative Housing Society.

Therefore, we request you to kindly incorporate these amendments into the Apartment Act and ensure that flat-owners do get their fundamental rights of ownership in true sense.
