An independent review of the South Australian Adoption Act 1988 undertaken by Professor Lorna Hallahan PhD has today recommended removing the current exclusion of same sex couples and single persons from the process of adoption within South Australia. This recommendation, enacted in law will place the best interests of vulnerable children within the context of suitably assessed, capable adoptive family units, and not just those potential adopters as outlined in section 12 of the current Act. Section 12 of the current Adoption Act prohibits adoption orders being made in favour of same-sex couples: “(1) Subject to this section, an adoption order will not be made except in favour of two persons who have been cohabiting together in a marriage relationship for a continuous period of at least five years.” We know from key experts and countless studies around the world that the human sexuality spectrum has no impact on ones ability to parent, or more specifically parenting outcomes. The impact rather is stigma, tokenism, and a lack of understanding and support amongst those who should know better. We therefore welcome the recommendations made by Professor Hallahan in these specific areas and call on the SA Government to move swiftly to introduce an Adoption Amendment Bill (2016) L.Hallahan: Adoption Act 1988 (SA) Review September 2015. 9.1.3 Conclusions – page 45 Same sex couples and single persons - I therefore conclude, that, in order to contribute to building the optimal conditions for adoption, and on the best available evidence, there should be no further distinction made within the Adoption Act regarding the marital status of potential adoptive parents. Some religious groups have sought an exemption for their adoption agencies should the bar on same-sex couples and single persons be lifted. While these agencies do not currently operate in South Australia I have checked this across the jurisdictions. I conclude that, in the interests of uniformity of practice across all adoption agencies as a safeguard for optimal operations of the Act, this exemption should not be granted ‪#‎onelove‬
