Section 136 provides emergency powers for the police to temporarily detain a person so that they can place them in a place of safety, enabling them to receive help from a registered mental health practitioner. They have not committed any criminal offence, but this can sometimes be have a serious impact on the individuals future and recovery as the disclosure of a S136 could appear on the persons DBS when applying for a job, which is the police discretion, criminalising Mental health, help us get it removed it from guidelines by the home office.
