Waiting on the commissioner committee to provide a solution!

The commission committee seemed to be interpreting a thirty year lawsuit conclusion by a judge as a law being passed that Shin Point can not be touched, instead of an opinion based off of those circumstances and evidence of the time that no longer applies as the situation has changed. All it would take to be a lawful road would be for the commissioner to accept Shin Point into their inventory (even though the proof reflects it’s always been a road). However, they claim Shin Point is a subdivision despite their being no subdivision plat on file in the courthouse. Their attorney is leaning on the Webster dictionary definition of the word subdivision as being a piece of land divided up into 3 or more lots. It’s illegal to create a subdivision without going through the proper procedures first, none of which was done for Shin Point Road. Therefore it’s not a subdivision and should not be held to the expensive rules of such. Tax paying individuals should not be held to the road standards of a developer and they should not be held in limbo indefinitely based off of the failures of Marshall county or a dead land owner. All roads start out like Shin Point road and did not require the public to pay for a road prior to the county accepting it. We are anxiously awaiting a solution from the commission committee and are hopeful. Keep the signatures coming as this is NOT over yet! Thank you for your continued support!
