The 48.1 Million Dollar Birth Injury Jury Verdict is the "Flag Ship" malpractice jury award since March 2025. In Jan. / Feb. 2026 Albert B. Pepper Jr. consumer advocate, litigant pro se broke the story that nine minutes before the jury rendered their verdict that the gross recovery amount was capped at 18 million dollars.
 
Proceeding to do press releases of the 48.1 million dollar verdict without disclosure of the high / low agreement cap was a 30.1 million dollar omission of fact.
