I was very excited that less than 24hrs after sending the email to Greg Hunt I received a response and signature from who must be a very busy Proffesor Paul Fitzgerald. He validating (far more eloquently than me) my concerns who added that he knows of know other medical procedure with such a lifetime cap. 
I also tried to pull up the document I had found outlining the framework to the MBS....progress or mystery I'm not sure.
