My story in short
I had a solicitor deal with my case after my son’s death he asked to see any documents I was named on but he was unable to obtain them I phoned the company to tell them I was named I was told there was no paperwork in my name which was untrue. I wrote many letters and after nearly three years I received a copy of the document I was named on Discretionary allows them to withhold this information from the person or persons you have named
I put a complaint in to the insurance company for further information but again Discretionary allows them to withhold information from you in my case the very same person who dealt with my complaint dealt with the funds to so I had no chance of getting the answers I wanted
The point is your expression of wishes are not legally binding the company may pay funds to a person or persons you haven’t named they could pay 25 percent to the person named and 75 percent to person who is not named or nothing to the person you have named but pay all funds to a person you haven’t named again Discretionary allows the trustees to do this
Please keep your expression of wishes updated if you get married or remarried but did not renew your expression of wishes after you get married the trustees can say you probably forgot to up date and can then pay funds to someone else in your family or friends please remember you can name anyone on your form
The company are not legally obliged to share any information with the loved ones you have named they may not receive the funds you wanted them to in the event of your death
You are signing your wishes over to the trustees this may not happen to everyone but it does happen to some
If you have named a loved one on your expression of wishes form this doesn’t go through probate if there is no will if the person you have named can’t be found or they have died then your funds will go through probate
Discretionary needs to be removed so our loved ones we have named are entitled to see all information on what happened to your funds in the event of your death
