Global Petition to Stop the Genocide of Hazaras, Prevent Forced Displacement, Achieve Justice, and Ensure Non-Recurrence

Introduction: Urgent Action to Protect the Lives of Hazaras

We, the signatories of this petition, call on the international community to take immediate, coordinated, and effective measures to protect the lives of Hazaras, stop crimes, prevent forced displacement, ensure justice, and investigate and legally recognize the genocide of Hazaras based on credible evidence and the standards of international law.

For more than a century, the Hazara people have experienced repeated periods of mass killings, repression, forced displacement, dispossession, structural discrimination, and deprivation of fundamental rights. The atrocities during the reign of Amir Abdur Rahman Khan in the late nineteenth century represent a defining chapter in the history of suffering and repression endured by Hazaras. In subsequent decades, targeted violence, deadly attacks against civilians, and discrimination based on ethnic and religious identity have posed serious threats to the security and fundamental rights of this community.

In recent years, deadly attacks against Hazaras in schools, educational institutions, mosques, cultural centers, and residential areas have once again demonstrated the urgent need for effective protection of this community. At the same time, reports of forced displacement, land seizure and confiscation, structural deprivation, and restrictions on fundamental rights have raised serious concerns about the security, right to residence, property rights, and future of this community.

Hazara women and girls also require special protection in light of the risks arising from ethnic and religious discrimination and gender-based restrictions.

We emphasize that the protection of human life must not be delayed until the completion of legal investigations. At the same time, independent investigations into past and present crimes, the establishment of truth, accountability for perpetrators, and guarantees of non-recurrence must be pursued with determination.

Specific Demands to the International Community

1. Immediate Protection of the Lives of Hazaras

We call on the United Nations, governments, and competent authorities to seriously assess the threats facing Hazaras, strengthen early-warning mechanisms, and take practical measures to protect civilians and prevent genocide and other international crimes.

2. Prevention of Forced Displacement and Dispossession

We call on the international community to take immediate and effective measures to prevent the forced displacement of Hazaras, their unlawful eviction from their places of residence, land seizures, and dispossession. Reported cases must be independently investigated, and conditions must be established for the safe, voluntary, and dignified return of displaced persons, the restoration of property rights, and compensation for those affected.

3. Investigation and Legal Recognition of the Genocide of Hazaras

We call on governments, parliaments, and competent institutions to examine historical and contemporary evidence concerning crimes against Hazaras in accordance with the standards of international law and to pursue the process of legally recognizing the genocide of Hazaras.

4. Establishment of an Independent Truth-Seeking and Documentation Mechanism

We call on the United Nations and competent institutions to ensure comprehensive and impartial investigations into mass killings, targeted attacks, forced displacement, dispossession, and other serious human rights violations by establishing an independent mechanism or strengthening existing mechanisms. The preservation of evidence and the safety of victims and witnesses must be among the priorities of this process.

5. Accountability for Perpetrators and Ending Impunity

We call on competent national and international judicial authorities, within their respective jurisdictions and under applicable laws, to facilitate investigations and the prosecution of individuals responsible for international crimes against Hazaras and to protect the rights of victims and survivors.

6. Ending Discrimination and Ensuring Equal Rights

We call on governments and international institutions to take effective measures to end ethnic and religious discrimination against Hazaras and ensure their equal access to education, employment, public services, justice, security, and political and social participation. Protecting the rights of Hazara women and girls must also be a priority.

7. Protection of Historical Memory and Guarantees of Non-Recurrence

We call on governments, universities, research institutions, and human rights organizations to support the documentation and preservation of historical records, victims' testimonies, and Hazara cultural heritage, and to adopt effective measures to prevent the recurrence of mass killings, forced displacement, dispossession, and other crimes.

Global Call for Truth, Justice, and Action

We invite people worldwide, academics, researchers, legal professionals, civil society organizations, and human rights defenders to sign this petition and support the demands of the Hazara people for protection of life, an end to crimes, prevention of forced displacement, justice, and guarantees of non-recurrence.

We call on governments and international institutions to translate these demands into immediate, specific, effective, and actionable measures.

Genocide must stop; forced displacement must end; the truth must be established; justice must be achieved.

مقدمه: اقدام فوری برای حفاظت از جان هزاره‌ها

ما، امضاکنندگان این دادخواست، از جامعه جهانی می‌خواهیم که برای حفاظت از جان مردم هزاره، توقف جنایات، جلوگیری از کوچ اجباری، تأمین عدالت و بررسی و به‌رسمیت‌شناسی حقوقی نسل‌کشی هزاره‌ها بر پایه شواهد معتبر و معیارهای حقوق بین‌الملل، اقدامات فوری، هماهنگ و مؤثر اتخاذ کند.

مردم هزاره در بیش از یک قرن گذشته، دوره‌های متعددی از کشتار، سرکوب، آوارگی اجباری، سلب مالکیت، تبعیض ساختاری و محرومیت از حقوق اساسی را تجربه کرده‌اند. فجایع دوران امیر عبدالرحمان خان در اواخر قرن نوزدهم، نقطه‌ای تعیین‌کننده در تاریخ رنج و سرکوب هزاره‌ها به شمار می‌رود. در دهه‌های بعد نیز خشونت‌های هدفمند، حملات مرگبار علیه غیرنظامیان و تبعیض‌های مبتنی بر هویت قومی و مذهبی، امنیت و حقوق بنیادین این جامعه را با تهدیدهای جدی مواجه ساخته است.

در سال‌های اخیر، حملات مرگبار علیه هزاره‌ها در مکاتب، مراکز آموزشی، مساجد، مراکز فرهنگی و مناطق مسکونی، ضرورت حفاظت مؤثر از این جامعه را بار دیگر آشکار ساخته است. هم‌زمان، گزارش‌های مربوط به کوچ اجباری، تصرف و مصادره زمین‌ها، محرومیت‌های ساختاری و محدودیت حقوق اساسی، نگرانی‌های جدی درباره امنیت، حق سکونت، مالکیت و آینده این جامعه ایجاد کرده‌اند.

زنان و دختران هزاره نیز با توجه به خطرهای ناشی از تبعیض قومی و مذهبی و محدودیت‌های جنسیتی، به حمایت ویژه نیاز دارند.

ما تأکید می‌کنیم که حفاظت از جان انسان‌ها نباید تا پایان تحقیقات حقوقی به تعویق افتد. در عین حال، بررسی مستقل جنایات گذشته و معاصر، روشن‌شدن حقیقت، پاسخ‌گویی عاملان و تضمین عدم تکرار باید با جدیت دنبال شود.

درخواست‌های مشخص از جامعه جهانی

۱. حفاظت فوری از جان مردم هزاره

از سازمان ملل متحد، دولت‌ها و نهادهای ذی‌صلاح می‌خواهیم که خطرهای متوجه هزاره‌ها را به‌طور جدی ارزیابی کنند، سازوکارهای هشدار زودهنگام را تقویت نمایند و اقدامات عملی برای حفاظت از غیرنظامیان و پیشگیری از نسل‌کشی و سایر جنایات بین‌المللی اتخاذ کنند.

۲. جلوگیری از کوچ اجباری و سلب مالکیت

از جامعه جهانی می‌خواهیم که برای جلوگیری از کوچ اجباری هزاره‌ها، اخراج غیرقانونی آنان از محل سکونت، تصرف زمین‌ها و سلب مالکیت، اقدامات فوری و مؤثر اتخاذ کند. موارد گزارش‌شده باید به‌صورت مستقل بررسی شوند و زمینه بازگشت امن، داوطلبانه و باکرامت آوارگان، احقاق حقوق مالکیت و جبران خسارت آسیب‌دیدگان فراهم گردد.

۳. بررسی و به‌رسمیت‌شناسی حقوقی نسل‌کشی هزاره‌ها

از دولت‌ها، پارلمان‌ها و نهادهای صلاحیت‌دار می‌خواهیم که شواهد تاریخی و معاصر مربوط به جنایات علیه هزاره‌ها را بر اساس معیارهای حقوق بین‌الملل بررسی کرده و روند به‌رسمیت‌شناسی حقوقی نسل‌کشی هزاره‌ها را پیگیری کنند.

۴. ایجاد سازوکار مستقل حقیقت‌یابی و مستندسازی

از سازمان ملل متحد و نهادهای ذی‌صلاح می‌خواهیم که با ایجاد سازوکار مستقل یا تقویت سازوکارهای موجود، بررسی جامع و بی‌طرفانه کشتارها، حملات هدفمند، کوچ اجباری، سلب مالکیت و سایر موارد نقض جدی حقوق بشر را تضمین کنند. حفاظت از شواهد و امنیت قربانیان و شاهدان باید از اولویت‌های این روند باشد.

۵. پاسخ‌گویی عاملان و پایان‌دادن به مصونیت از مجازات

از مراجع قضایی صلاحیت‌دار ملی و بین‌المللی می‌خواهیم که در چارچوب صلاحیت‌ها و قوانین قابل اجرا، زمینه تحقیق و پیگرد قانونی افراد مسئول جنایات بین‌المللی علیه هزاره‌ها را فراهم سازند و از حقوق قربانیان و بازماندگان حمایت کنند.

۶. پایان‌دادن به تبعیض و تضمین حقوق برابر

از دولت‌ها و نهادهای بین‌المللی می‌خواهیم که برای پایان‌دادن به تبعیض قومی و مذهبی علیه هزاره‌ها و تضمین دسترسی برابر آنان به آموزش، اشتغال، خدمات عمومی، عدالت، امنیت و مشارکت سیاسی و اجتماعی اقدامات مؤثر انجام دهند. حفاظت از حقوق زنان و دختران هزاره نیز باید در اولویت قرار گیرد.

۷. حفاظت از حافظه تاریخی و تضمین عدم تکرار

از دولت‌ها، دانشگاه‌ها، مراکز پژوهشی و سازمان‌های مدافع حقوق بشر می‌خواهیم که از ثبت و حفاظت اسناد تاریخی، شهادت قربانیان و میراث فرهنگی هزاره‌ها حمایت کنند و تدابیر مؤثر برای جلوگیری از تکرار کشتار، کوچ اجباری، سلب مالکیت و سایر جنایات اتخاذ نمایند.

فراخوان جهانی برای حقیقت، عدالت و اقدام

از شهروندان سراسر جهان، دانشگاهیان، پژوهشگران، حقوقدانان، نهادهای مدنی و مدافعان حقوق بشر دعوت می‌کنیم که با امضای این دادخواست، از مطالبات مردم هزاره برای حفاظت از جان، توقف جنایات، جلوگیری از کوچ اجباری، عدالت و تضمین عدم تکرار حمایت کنند.

از دولت‌ها و نهادهای بین‌المللی می‌خواهیم که این مطالبات را به اقدامات فوری، مشخص، قابل پیگیری و مؤثر تبدیل کنند.

نسل‌کشی باید متوقف شود؛ کوچ اجباری باید پایان یابد؛ حقیقت باید روشن شود؛ عدالت باید تحقق یابد.

توقف نسل‌کشی هزاره‌ها؛ جلوگیری از کوچ اجباری؛ عدالت برای قربانیان؛ تضمین عدم تکرار.
