Equal Protection Rights of California citizens from the contamination at Santa Susana Field Lab:

A recently reached settlement agreement with Boeing has alarming implications, allowing for up to 94% of the contaminated site to remain polluted.

This decision has sparked serious concerns regarding the level of protection afforded to local residents.

From my perspective, it feels like we are witnessing an irreversible decline; if only a fraction of the site is cleaned, what is the point of the cleanup at all?

We contend that ignoring the community’s genuine concerns is a significant failure in addressing the existing contamination.

This negligence not only infringes upon the community’s right to a safe and healthy environment but also undermines their constitutional rights under the 14th Amendment, which guarantees equal protection under the law.

Research documents a staggering 60% higher incidence of cancer among individuals living within a two-mile radius of the site, underscoring the urgent need for action.

The community’s struggle seeks to establish robust regulatory rights that will ensure the safety and well-being of all citizens in California, safeguarding them from the perils posed by this superfund contamination site.

Just a suggestion...Fight back in several ways: stay and demand a comprehensive clean up, or demand full value of your property to purchase from you with Boeing, to start over, and Boeing pays for your medical-legal responsibilities currently and long term from their gross negligence judgment against the community at large.

Do both refuse to have this nightmare kicked down the street for your grandchildren to deal with? We have everything to lose, our family members, friends, animals and property rights and value.

Here is our opportunity to remove these chains of lies, delays and denial.

Your struggles are real and concerning. The atmosphere of neglect and abandonment is tangible.

Alone, we can do so little; together, we can do so much. Walk along with us in the opportunity of change and collective care to hold everyone up and out of the war zone.

Of contamination chemicals/ radiation poisoning from funerals, hospital visits, repeated medical care, intentional infliction of emotional distress, loss of property value, loss of security and peace, the duty to inform and unreasonable interference with health, safety and property rights of the community in ultra-hazardous activities and environment.

Caselaw: Rylands V. Fletcher

Activities that involve risk of serious harm and cannot be performed with complete safety.

1. Liability
2. Strict Liability
3. Absolute Nuisance
4. Non-Natural Use of Land @ The real estate firms, city, state and federal government must have been aware that the community near Boeing was contaminated, yet they still sold the property to the owners, who eventually became sick and had dying family members.

1.
These properties should have been prohibited from sale due to significant environmental harm such as hazardous waste from Boeing operation in the sensitive areas of this community of Simi Valley and surrounding communities. No implementation to reduce waste [years ago] was met to promote a healthy environment.

2.
These chemicals and pollution have led to legal liabilities and environmental consequences in Simi Valley and nearby communities.

3.
While demanding change, letter writing campaigns, sit-ins, protests and wondering how the federal, state, city and Boeing are legally liable.  Our hierarchy of needs and rights of human beings was completely ignored.

4.
Political posturing will not win at the end of the day.

       Consequences:

1.
Zoning laws and ineffective managing land use can cause a huge liability to the city, state and federal authorities.

2.
This factor can hold the authorities legally accountable as a whole and as individuals for keeping this information from getting out to the public domain, therefore contributing to allegedly homicide deaths of persons/animals, causing people to get sick and loss of property values.

3.
As a community and individuals, continue to insert your legal rights under the 14 Amendment of equal protection, personal injury tort laws and other laws you deem necessary.

4.
Never give in or up. We will see you at the contaminated, let's go.
