Nous, soussigné-es, vous demandons d’exercer immédiatement vos pouvoirs discrétionnaires en tant que ministre de l’Immigration, des Réfugiés et de la Citoyenneté afin de suspendre le renvoi de Mme Paulina et ses deux fils, prévu le 23 juillet 2026, alors que le père et un jeune enfant d’un an et demi resteraient au Canada.
Ce renvoi de trois membres de la famille entraînerait la séparation d’un enfant d’un an et demi de sa mère, et la séparation de deux enfants de leur père et de leur jeune frère : c’est tout simplement inacceptable.
Parcours migratoire
Mme Paulina et son conjoint ont tous deux demandé l’asile au Canada en 2022, arrivant a quelques mois d’intervalles avec leur deux enfants, après avoir fui l’Angola en raison de violences graves et de menaces visant leur famille, incluant un viol.
Lors de la préparation de leur demande d’asile, Madame et son conjoint ont éprouvé des difficultés à rassembler les documents nécessaires pour bien documenter les menaces et les événements vécus. Leurs demandes étaient initialement séparées car ils ne sont pas arrivés en même temps, et étaient représentés par deux avocats. Ils ont soumis séparément leurs demandes, qui ont été jointes par le tribunal ensuite. Mais ils ont été insuffisamment et mal conseillés : leur narratif déposé était très court et peu détaillé, et l’avocat ne les a pas suffisamment soutenu pour préparer les documents de preuve.
En août 2025, la demande d’asile de la famille a été refusée de façon extrêmement sévère. La CISR a classé leur demande comme ‘’dénuée de fondement’’, un refus très sévère qui a comme grave conséquence de leur enlever le droit de faire appel du refus. Lors de l’audience, le viol vécu par Madame n’a pas du tout été abordé et considéré, ni dans la décision de refus. Cet aspect du danger a été tout simplement ignoré.
Leur seule possibilité pour contester ce refus très sévère a été de déposer un contrôle judiciaire en Cour fédérale, ce qu’ils ont fait rapidement avec leur conseil. Ils sont à ce jour en attente d’une décision de la Cour fédérale quant à ce contrôle judiciaire.
Renvoi et séparation familiale
Madame et ses deux enfants sont citoyens de l’Angola, alors que le père est citoyen de la République démocratique du Congo (RDC). Depuis leur arrivée au Canada, ils ont eu un troisième enfant, qui est citoyenne canadienne, et a aujourd’hui un an et demi. En avril 2026, ils ont été convoqués à l’agence des services frontaliers. Comme la RDC est un pays moratoire vers lequel le Canada n’effectue pas de renvois, l’AFSC leur a annoncé que seulement la mère et ses deux enfants angolais seraient déportés, et qu’il leur revenait de décider si le bébé canadien resterait avec le père, ou partirait avec la mère. Devant les graves menaces en Angola, le couple a fait un choix déchirant, et a confirmé à l’AFSC que le père resterait derrière avec l’enfant.
En juin 2026, le couple a demandé du soutien au Collectif Bienvenue. Devant la situation exceptionnelle, une nouvelle représentation juridique de qualité a été mobilisée. Cette nouvelle avocate présente de nouveaux recours pour tenter de suspendre le renvoi et la séparation familiale imminente du 23 juillet 2026. Il est minuit moins une : cette famille risque d’être séparée de façon indéfinie: nous demandons que le renvoi soit suspendu jusqu’à ce que toutes les procédures de régularisation soient menées en bonne et due forme.
Nous considérons que ce renvoi est à la fois cruel, précipité et contraire aux principes d'intérêt supérieur de l'enfant. Il est de notre devoir collectif de protéger les familles et de tenir compte des réalités humaines derrière les procédures administratives : Les familles doivent rester ensemble.
Nous demandons donc la suspension immédiate du renvoi de Mme Paulina et de ses deux enfants, prévu le 23 juillet 2026, et une réévaluation du dossier avec humanité et discernement.

We, the undersigned, call upon you to immediately exercise your discretionary powers as Minister of Immigration, Refugees and Citizenship to suspend the removal of Ms. Paulina and her two sons, scheduled for July 23, 2026, while the father and a young child of a year and a half would remain in Canada.
This removal of three family members would result in the separation of a year-and-a-half-old child from his mother, and the separation of two children from their father and their young brother: this is simply unacceptable.
Migration Journey
Ms. Paulina and her spouse both applied for asylum in Canada in 2022, arriving a few months apart with their two children, after fleeing Angola due to severe violence and threats targeting their family, including a rape.
While preparing their asylum claim, Madame and her spouse experienced difficulties gathering the necessary documents to properly document the threats and events they endured. Their applications were initially separate because they did not arrive at the same time, and they were represented by two different lawyers. They submitted their claims separately, which were subsequently joined by the tribunal. However, they received inadequate and poor advice: the narrative they submitted was very short and lacked detail, and the lawyer did not sufficiently support them in preparing evidentiary documents.
In August 2025, the family's asylum application was rejected in an extremely harsh manner. The IRB (Immigration and Refugee Board) classified their claim as "manifestly unfounded," a very severe refusal that has the grave consequence of stripping them of their right to appeal the decision. During the hearing, the rape experienced by Madame was not addressed or considered at all, nor was it mentioned in the refusal decision. This aspect of the danger was simply ignored.
Their only option to challenge this severe refusal was to file for judicial review in Federal Court, which they did quickly with their counsel. To date, they are awaiting the review of this judicial review.
Removal and Family Separation
Madame and her two children are citizens of Angola, while the father is a citizen of the Democratic Republic of Congo (DRC). Since their arrival in Canada, they had a child who is a Canadian citizen and is now a year and a half old. In avril 2026, they were summoned by the Border Services Agency. As the DRC is a country under a temporary moratorium onto which Canada does not deport, the CBSA announced to them that only the mother and her two Angolan children would be deported, and that it was up to them to decide whether the Canadian baby would stay with the father or leave with the mother. Faced with severe threats in Angola, the couple made a heartbreaking choice and confirmed to the CBSA that the father would stay behind with the child.
In June 2026, the couple sought support from the Collectif Bienvenue. Given the exceptional situation, high-quality legal representation was mobilized. This new lawyer is pursuing new remedies to attempt to suspend the removal and the imminent family separation on July 23, 2026. Time is running out: this family risks being separated indefinitely. We request that the removal be suspended until all regularization procedures are properly and fully carried out.
We consider this removal to be cruel, hasty, and contrary to the principles of the best interests of the child. It is our collective duty to protect families and to consider the human realities behind administrative procedures: Families must stay together.
We therefore demand the immediate suspension of the removal of Ms. Paulina and her two children, scheduled for July 23, 2026, and a re-evaluation of the case with humanity and discernment.
