Herein is the Ex Parte Order of Protection filed by Anthony R. Friedman (Petitioner) on April 9, 2026 naming Albert B. Pepper Jr (Respondent) in the 11th Judicial Circuit in St. Charles County Missouri.
This reckless filing, in an act of desperation by Friedman the Petition was an act of attempting to secure a “prior restraint” upon the consumer advocacy and citizen journalism of Pepper and his social media expose with regard to the business and professional conduct, misconduct of Friedman the Petitioner.
On May 13, 2026 a motion hearing was held in Div. 12 of the 11th Judicial Circuit of St. Charles County before the Hon. William Byrnes.
After review of Friedmans petition, Peppers responsive answer, Motion to Dismiss With Prejudice and oral arguments rendered by Friedman and Pepper Judge Byrnes granted Peppers Motion to Dismiss with Prejudice in full without any amendments or stipulations.
This Petition for an Ex Parte Order of Protection is now presented for review and legal analysis to expose the multitude of allegations that were found to be without a basis in fact and the recklessness of the petition that has nor resulted in a supplemental filing with the Office of Chief Disciplinary Counsel of the Supreme Court of Missouri (File #25–2531-X).
Furthermore, the respondent, Pepper is now proceeding to prepare a complaint and evidentiary package for allegations of perjury naming Anthony R. Friedman to be presented to the St. Charles County Prosecuting Attorney for review seeking formal charges and prosecution.

Dear Mr. McCulloch:
I respectfully submit this formal Criminal Complaint alleging that Anthony R. Friedman, a licensed Missouri attorney (Bar No. 65531), committed Perjury, a Class E Felony, by knowingly filing a verified Petition for Order of Protection containing multiple material false statements under oath.
Mr. Friedman previously represented me as counsel in a medical malpractice action. He therefore possessed intimate personal knowledge of my severe spinal cord injury, mobility limitations, supervised residential care placement approximately 95 miles away in Doe Run, Missouri, and my eight-year absence from St. Charles County. Despite this knowledge, he swore to allegations of ongoing in-person stalking, firearm access, and immediate physical danger that were objectively false and physically impossible.
On May 13, 2026, the Honorable William Byrnes dismissed the Petition with prejudice after a full evidentiary hearing.
Enclosed is a verified Criminal Complaint along with a comprehensive evidentiary package. I am available at any time for an interview and can promptly provide certified copies of all court records.
This matter involves an officer of the court who appears to have misused the judicial process for retaliatory purposes. I respectfully request that your office conduct a thorough investigation and consider criminal prosecution.

CRIMINAL COMPLAINT FOR PERJURY
(RSMo § 575.040 – Class E Felony)
COMES NOW Albert B. Pepper Jr., Complainant, and respectfully submits this Criminal Complaint against Anthony R. Friedman for the crime of Perjury, a Class E Felony, pursuant to RSMo § 575.040, and states as follows:
I. JURISDICTION AND VENUE
This Complaint is filed in St. Charles County, Missouri, where the offense occurred. Respondent filed a verified Petition for Order of Protection containing false statements under oath in the 11th Judicial Circuit Court, St. Charles County (Case No. 2611-PN00554).
II. PARTIES
Complainant Albert B. Pepper Jr. is a resident of Doe Run, Missouri, currently residing in a supervised residential care facility.
Respondent Anthony R. Friedman is a licensed Missouri attorney (Bar No. 65531) who previously represented Complainant in a medical malpractice action (Case No. 19SL-CC04680). As such, Respondent had detailed personal knowledge of Complainant’s severe physical limitations, medical history, residential placement, and circumstances.
III. FACTUAL ALLEGATIONS
On or about April 9, 2026, Respondent filed a verified Petition for Order of Protection against Complainant, swearing under penalty of perjury that the contents were true.
The Petition contained multiple material false statements, including but not limited to:
a. Allegations of ongoing in-person stalking, including following Complainant, looking in windows, and lingering outside Petitioner’s residence on a “daily, multiple times a day” basis from Spring 2024 through April 2026;
b. Claims that Complainant carries or has access to a firearm or weapon and has threatened Petitioner with physical harm;
c. Allegations that Complainant posted a “car bombing” video specifically referencing Petitioner by name as a violent threat;
d. Claims that Complainant published Petitioner’s home address alongside violent imagery, supported by GPS coordinates that actually identify Energizer Park (a public soccer stadium in St. Louis), not a private residence.
These statements were objectively false. At all relevant times, Complainant:
Suffered from a severe spinal cord injury resulting in significant mobility impairment and requires a cane for ambulation;
Has resided continuously in a supervised residential care facility on a 500-acre ranch in Doe Run, Missouri, approximately 95 miles from St. Charles County;
Has not possessed a vehicle or valid driver’s license for many years;
Has not been physically present in St. Charles County for approximately eight years;
Does not own or have access to any firearms.
Respondent knew these facts to be false. As Complainant’s former attorney, he had direct access to medical records, discovery materials, and personal knowledge of Complainant’s physical condition, residential placement, lack of transportation, and overall circumstances.
The false statements were material because they directly addressed the statutory requirement of “immediate and present danger” necessary for issuance of an ex parte Order of Protection under RSMo Chapter 455.
On May 13, 2026, the Honorable William Byrnes dismissed Respondent’s Petition with prejudice after a full evidentiary hearing.
IV. ELEMENTS OF PERJURY (RSMo § 575.040)
Respondent committed Perjury by:
Knowingly making false statements under oath in an official judicial proceeding;
With the purpose to deceive the Court;
Concerning material facts that substantially affected the outcome of the proceeding.
V. ADDITIONAL CONTEXT
The filing of this Petition occurred while an active investigation by the Office of Chief Disciplinary Counsel (File #25-2531-X) was pending against Respondent, in which Complainant is the named complainant. The timing and content of the Petition strongly suggest it was motivated, at least in part, by retaliation against Complainant’s protected consumer advocacy and citizen journalism activities.
VI. REQUEST FOR RELIEF
Complainant respectfully requests that the Prosecuting Attorney:
Conduct a full investigation into this matter, including review of the complete court file and supporting exhibits;
File appropriate criminal charges against Anthony R. Friedman for Perjury (Class E Felony);
Present this matter to the Circuit Court of St. Charles County for issuance of a warrant or summons as appropriate.
WHEREFORE, Complainant prays that the Prosecuting Attorney take all actions deemed necessary and proper.

The following are the applicable Missouri Statutes
### 1. Perjury — § 575.040 RSMo
This is the primary statute governing false statements made during official live proceedings.
The Violation: A person commits perjury if, with the purpose to deceive, they knowingly testify falsely to any material fact under a legally administered oath or affirmation in an official proceeding before a court.
Application: This applies directly to live false testimony or false statements given during a motion hearing, an ex parte permanent protective order hearing, or a deposition.
