It is almost 4 years since Maple Batalia was murdered as she was leaving campus at Simon Fraser University where she was a Health Sciences student. Four long years and yet those accused of her murder have yet to be prosecuted. That’s four long years that her family have waited. Four years in which they have grieved and turned that grief into raising thousands of dollars for a scholarship in Maple’s name. Yet this is also four long years without justice. In those four years the accused have been investigated and charges laid but justice has not been delivered.
Why? delays and tactics such as the accused changing lawyers and requesting postponements have kept this case an open wound for Maple’s family. There have been times when her parents flew back from a visit to India to attend court, for twenty minutes! Yes, twenty minutes was all it took for the accused to have the case rescheduled.
The Batalia family is well aware this is not only justice delayed for them but is repeated across Canada on a daily basis. Postponements are sometimes necessary but so is rapid rescheduling. The Batalia family ask you to join their call to change this. Here’s what they want to see happen:
1. A restriction on the use of tactics such as changing lawyers to get postponements
2. Additional resources to be provided so cases can be scheduled and rescheduled as quickly as possible
3. Additional victim support services such as counselling for those affected by violent crime
To achieve this will take change at both Provincial and Federal government; the BC Provincial Supreme Court (where such crimes as murder are tried) is funded by the Province but judges are appointed and funded by the Federal Government. We call on both of these, and other Provincial legislatures, to make the necessary changes to deliver justice in a timely fashion.
Justice delayed is not justice delivered.
