NO jail time for first time offender on a divorce decree contempt charge
The Issue
We all know sometimes marriages don’t work and for the state of Kentucky there is a no fault so no matter who did what, the man usually gets stuck with the raw end of the deal. My friend, Guy Wilson, has been found in contempt because he has not been able to sell or refinance the home that he and his wife shared that she moved out of. He had the home up for sale for months but no luck in selling it. He decided he would refinance to get her name off of the home but it has taken longer than expected. These types of issues are out of our hands sometimes. He was injured at work and had surgery this past summer which caused a child support issue because he was receiving disability checks and they were not taking out his wage assignment like they did on his payroll checks. He owes her a couple of hundred dollars on child support and some other moneys on attorney’s fees, etc.. He is not going to be able to pay anything if he has to serve out the 180 days that Judge Dolly Wisman Berry has put on him because he will probably lose his job. He is a manager/supervisor where he works and has had to spend the last several weeks out of town to build up a new location for the company. How does this judge think giving Guy a 6 month sentence with work release is going to achieve resolution of the issues at hand? He needs an extension and needs to be able to work before he loses his job and can pay nothing. He has no record, never has been in trouble yet this judge gives him more time than a drug offender or DUI offender. Guy also has an 8 year old daughter that he talks to EVERY night and now, because of this, he has missed phone calls and she doesn’t understand why!!! Let’s show Judge Berry she needs to get her legal and moral priorities straight! Let’s get Guy back to his life so he can resolve all issues with his ex-wife and go on with his life! It is often said by officials (police officers, etc.) that "I guess you got her/him when they were in a bad mood". THIS IS NOT RIGHT! Life altering decisions should not be made on a judges mood swing! It's not a very smart thing to do, taking a man away from his children and job to get things finalized.
