So should Facebook: "The Obama administration says requiring proof that a speaker intended to be threatening would undermine the law’s protective purpose. In its brief to the court, the Justice Department argues that no matter what someone believes about his comments, it doesn’t lessen the fear and anxiety they might cause for other people." Yet, they continue to let other violent threats pass. For example, they did not find this a threat: https://www.facebook.com/misguidedchildren/photos/a.822349084451059.1073741830.737643792921589/898223093530324/?type=1 So, Facebook okays when a page reposts a threat for whatever purpose instead of calling out the page for not reporting the threat and leaving it at that.
