I am awaiting the final opinion of Marc Willers QC of Garden Court Chambers on whether there are grounds for challenging the housing targets for Kingston in the London Plan and also more broadly on the lack of protection for habitats that are legally protected under the Habitats Directive.
In the meantime, Mr Willers has said that there are grounds for a legal challenge on the weakening of policies for the protection of heritage assets across London. Protection in the current London Plan already appears weaker than provided by national law and the new plan removes protection even further.
