

1. The State has a monopoly on violence which means the State can use force by all means in the name of public safety.
2. As State agents police officers have the right to use the State monopoly on violence when they deem it necessary, rightly or wrongly. They killed Sammy and the killing was justified because he was a threat to the police, so they say but the video contradicts that argument.

Delictual….“Delict (from Latin dēlictum, past participle of dēlinquere ‘to be at fault, offend’) is a term in civil law jurisdictions for a civil wrong consisting of an intentional or negligent breach of duty of care that inflicts loss or harm and which triggers legal liability for the wrongdoer”
By all accounts Sammy was a defenseless individual and victim of this abuse of rights. There was a negligent breach of duty of care by the police as agents of the State that inflicted harm and loss of life.
As they said Sammy was confused. If Sammy was in Amsterdam to celebrate his birthday something happened in that city that led to the confusion. Where did the confusion come from?
The breach of duty of care caused harm and loss of life and the actual wrongdoer with legal liability in this matter is not the police officer who pulled the trigger and fired bang, bang, bang, but the City of Amsterdam that has no regard for human life, unless you belong to one of their favored 'minority groups' you have no legal protection from violence.
