Today I attended Day 2 of “Becky’s hearing to observe. As we have said previously she has been scheduled for a 7day hearing due to complete next Tuesday. “Becky”has to fund her own legal representation and as such can only afford to pay for her legal advisor to attend for 3 days. Therefore we were hoping that all witness cross examination would be done in this time and final submissions could be done by myself for no charge with her solo eater available for advice if we require it. The NMC have paid for 7witnessess to attend and give their evidence. 4 if these witnesses have all travelled down together and although advised by the panel that they should not discuss the case until it’s conclusion we know that they will be doing so and are under no illusion that they will not be passing on info to the remaining 3 witnesses who attend on wed and are travelling down together tonight. We can do nothing about this except remain professional and rise above it. As well as paying for their travel they are paying for accommodation plus a £25 per day per person allowance for food and any loss of earnings to attend. “Becky” has to pay for her own witnesses travel and accommodation which she can Ill afford but has done so as they will be able to collaborate her version of events. Yesterday new evidence,that “Becky” and her legal representative had been told could not be found and examined by them prior to the case was entered. Again nothing can be done except remain professional and try to deal with it. Today despite the panel and NMc barrister being told of “Becky’s financial and time restraints the case adjourned at 11.30 for the day as all witnesses for the day for the NMC had been dealt with. This means that the remaining witnesses for the NMC will be heard Tommorrow and it is unlikely that “Becky’s witnesses will be heard until Thursday. Worst case scenario is that they will be unable to stay another day and they won’t be able to give vital live evidence. “Becky” will then not be able to give her evidence and cross examination until Thursday, when her barrister will not be in attendance and give vital support particularly when the NMC barrister cross examines her. This is because “Becky” can not afford to pay for his attendance any longer. We will try our best to support her but it is clear that this will put her at a disadvantage. This is highly unfair and may affect the outcome of her case. We will be using the funds raised so far to pay for what we can but we clearly need a lot more funds to get anywhere near to being able to represent her on an equal basis. “Becky” already is unable to attend the final two days of her hearing as she can not afford to take anymore unpaid leave (as she has done already) from her non nursing job and also need to get home to her young son. Yes she can appeal later but we doubt she will have the strength to do so - it is wholly unfair and a potential miscarriage of justice… Please help
