When a court takes away a parent’s First Amendment rights, it doesn’t just silence the parent- it silences the child. The First Amendment does not disappear at the courthouse door. Yet in family court, parents- especially survivors of domestic violence- are routinely restricted from telling their stories, presenting evidence, or speaking openly about abuse. When that happens, the truth is suppressed, and children are left unprotected. Even more troubling, survivors who speak up are often reframed as the problem. Parents who try to protect their children are labeled “overprotective.” Survivors who report abuse are accused of “alienation.” Mothers and fathers who insist on safety are portrayed as “uncooperative” or “unstable.” But the reality is much simpler- and much more urgent: We are not trying to turn children against anyone. We are trying to keep them safe. In cases involving family violence, silencing a survivor goes even further. It undermines the very purpose of Anti-SLAPP protections, which exist to ensure people can speak about abuse without retaliation, punishment, or being discredited for telling the truth. So we have to ask the question courts too often avoid: How can we protect our children if we are not allowed to tell what happened to them? Children cannot testify freely. Children cannot file motions. Children cannot challenge false testimony. They rely on us- the adults who love them- to speak for them. When survivors are silenced and then punished for trying to protect their children, the system does not promote fairness. It protects silence. And silence is where abuse survives. This petition exists because truth matters. Evidence matters. And children deserve a court system that allows their stories to be told- not rewritten, dismissed, or buried.
