Alief Educators Are Openly Given Death Sentences

During Alief ISD’s December 18, 2018 school board meeting, the district held an open public hearing for the school board to consider and discuss recommendations of an independent hearing officer for Superintendent Henry David Chambers Jr (HD Chambers), and Assistant Superintendent of Human Resources Elizabeth Andrea Veloz-Powell’s recommendation to terminate a Miller Intermediate educators contract.

 
The backdrop of the hearing is that five years ago the educator was placed on administrative leave with pay in HISD for an incident that was never substantiated. Subsequently the educator sued HISD and won his lawsuit and was allowed by HISD to resign; since then the educator has been working for Alief ISD for several years now. An alleged incident occurred at Miller Intermediate and the educator was placed on administrative leave with pay by Superintendent Henry David Chamber Jr.  and Assistant Superintend of Human Resources Elizabeth Andrea Veloz-Powell. While on administrative leave with pay by Alief, Assistant Superintendent of Human Resources Elizabeth Andrea Veloz-Powel and Superintendent Henry David Chambers Jr. admittedly went on the internet and looked in to this educator’s lawsuit with HISD. This led HD Chambers and Elizabeth Powell to recommend the termination of this educators Alief contract without concluding the Alief ISD investigation of the incident which Alief had placed him on administrative leave with pay for, regarding the alleged incident at Miller Intermediate School. 


According to Alief ISD’s attorney, Jon Erik Nichols, Superintendent HD Chambers stated that Alief ISD would not have hired this educator had he put on his employment application that he was previously suspended with pay pending an investigation by HISD, giving no bearing to the fact that the educator was never found guilty of any wrongdoing and had won a lawsuit against HISD which upheld his innocence in a court of law. There are additional details which I will not go into in an effort to truncate the length of this communication.

 
My concerns are as follows, if Alief ISD administrators, HD Chambers, and Elizabeth Powell, as well as the district’s attorney openly acknowledge that they would refuse to hire an educator whom had ever been suspended with pay, or suspended without pay, regardless of the outcome of the said investigations, why does Alief ISD School Board rubberstamp and without proper investigation by the board allow Superintendent Henry David Chambers Jr. and Assistant Superintendent of Human Resources Elizabeth Andrea Veloz-Powell put Alief educators on administrative leave with or without pay pending any investigations by the district knowing full well that no matter the outcomes of those investigations that educator has been handed a death sentence on their careers as educators throughout the state of Texas by the educator merely being placed on suspension with or without pay? There is no consolation for an educator who may actually be found innocent of any and all allegations if the first step of all investigations is to place an employee on administrative leave, which will ultimately result in the termination of their contract and inability to be rehired in Alief or hired in any other district. This does not seem equitable or fair especially when the U.S. Constitution states that a person is innocent until proven guilty. In this case being proven innocent is still a guilty verdict and a death sentence for an educator’s career and livelihood; all of which is sealed by the rubber stamping process of Alief ISD school board. A person’s innocence should not require them to have to find a new career or give up their passion to educate our children. My question to you is what teacher/teachers are next to be suspended with pay and handed their death sentence by HD Chambers and Elizabeth Powell, sealed with a kiss by the board?
