The odor from Newby Landfill, because of the prevailing wind, has largely impacted nearby residents for a very long time. It is reaching its max capacity. 44+ landfill around SF bay have been closed at their max, but Newby landfill is pursuing a massive expansion. We need to stop the landfill from growing! Even though we are the odor victims of the Newby Landfill, we have no authority over the landfill but our neighbor city, San Jose does. They don’t care about us. We have to care about ourselves and our future generations! Federal regulations in 40 CFR Part 258 with which all landfills must comply, shows the location restrictions that landfills must be built in suitable geological areas away from faults, wetlands, flood plains or other restricted areas. Newby Landfill is not away from faults, wetlands, flood plains, and at the Bay front. It violates every criterion of a landfill and even more. This is a historical mistake that Newby was chosen as a landfill location. Now we can’t allow the mistake to remain incorrect and let it get bigger! The last year’s ground water testing result shows that Newby landfill’s 1000 year lasting liner has been deteriorated and found carcinogenic substance, 1,4 dioxane in the ground water! Folks, Newby is an old landfill and was a dump from 1930’s-50's. It was a dump; therefore there was no liner at all! Folks, you may be able to tolerate the odor, but no one can avoid the heath damage and sickness from the contaminated water and the air pollution! Folks, let’s stand up to protect ourselves and guard our basic human right! Permitting the Newby landfill is not allowed by the Federal regulation 40 CFR part 258, California Environmental Quality Control Act, and San Jose municipal code, but also a slow poison to nearby residents around Newby Landfill!
