Petition to the Parliament of Zimbabwe
A Call for a Mandatory DNA Prerequisite at Birth for Zimbabwean Children to Ensure Legal Identity, Paternity Certainty, and Child Protection
Petitioner: Nhlanhla Hugh Manzini
Addressed to: The Speaker of the National Assembly
To the Honourable Speaker of the National Assembly and Members of Parliament,

I, Nhlanhla Hugh Manzini, a citizen of Zimbabwe, in terms of Section 149 of the Constitution of Zimbabwe, which grants every citizen and permanent resident the right to petition Parliament, hereby submit this petition for your urgent consideration.

1. The Issue and My Concern
I am deeply concerned about the growing crisis of disputed paternity, the rising incidence of gender-based violence linked to these disputes, and the systemic vulnerability of children who lack a legally certain identity.

Recent public calls, including from Hon. Bridget Nyandoro (Southerton, Harare), for legislation mandating DNA testing at birth are a direct response to these pressing issues. The current system relies on a declaration of paternity, which is insufficient. A declaration is a legal formality, not a scientific certainty.

This gap has led to tragic outcomes:

Gender-based violence and femicide: Women have been killed after years of marriage when a partner discovers a child is not biologically theirs.
Unjust financial and legal burden on men: Many men have been forced to support, and even imprisoned for failing to support, children who are not biologically theirs.
Childhood trauma and identity crisis: Children often discover their true parentage late in life, leading to devastating psychological consequences.
Statelessness and lack of rights: Children without proper documentation, often due to complex paternity issues, are excluded from education, healthcare, and social protection.
Private DNA testing data cited in public debate indicates that a high proportion of paternity tests conducted in Zimbabwe return negative results, demonstrating that this is not an isolated problem but a widespread social reality.

2. My Petition
I respectfully call upon Parliament to take decisive action to protect the rights of children, ensure justice for men, and promote family stability by enacting legislation that makes DNA testing a prerequisite for the issuance of a birth certificate for all children born in Zimbabwe.

I specifically petition Parliament to:

a) Enact a Mandatory DNA Prerequisite for Birth Registration
Enact legislation that requires a DNA sample from the child, the mother, and the alleged father to be submitted as part of the birth registration process. The resulting DNA analysis should be attached to the birth certificate as official, scientifically verified proof of parentage.

b) Ensure Constitutional Alignment and Safeguards
This legislation must be carefully crafted to align with the Constitution of Zimbabwe. It must not violate the right to prompt provision of a birth certificate as enshrined in Section 81(1)(c)(i) of the Constitution. The law must include clear, expedited processes for cases where paternity is unknown, disputed, or the father is deceased, ensuring that every child receives a birth certificate and a legal identity.

c) Guarantee Affordability and Accessibility
For this mandate to be just and equitable, the government must ensure that DNA testing is affordable and accessible to all citizens. I propose that the government either:

Subsidize the cost of these tests, which currently range from US$120 to US$300.
Equip public hospitals and clinics with the necessary machinery and trained personnel to conduct these tests.
Partner with institutions such as the National University of Science and Technology (NUST) to provide low-cost or free testing at public health facilities.
d) Establish Robust Data Privacy and Protection Frameworks
I am acutely aware of the sensitivity of genetic data. Any national DNA database must be subject to the strictest privacy and data protection laws. The legislation must:

Prohibit the processing of genetic data without explicit, informed consent.
Ensure that DNA information is used solely for civil registration and child protection purposes, and never for unauthorized surveillance or discrimination.
Include severe penalties for the misuse or breach of this sensitive information.
3. Why This Matters: A Call for a Rights-Based Approach
This petition is not about punishment; it is about protection. It is about ensuring that a child's right to a legal identity is built on a foundation of truth, not assumption. It is about preventing the emotional and financial devastation that arises from paternity fraud. It is about giving men the certainty they deserve and protecting women from the violence that can erupt when that certainty is shattered.

Integrating DNA-supported birth registration will uphold constitutional rights and protect vulnerable children, aligning Zimbabwe's laws with its national, regional, and international human rights obligations.

4. Conclusion
No child should be rendered invisible because of unknown parentage. No man should be forced to support a child who is not his. No woman should live in fear of violence over a hidden truth. The current system is failing on all three fronts.

I therefore call upon Parliament to demonstrate leadership and courage by enacting the necessary legislation to make DNA testing at birth a prerequisite for birth registration, with all the safeguards, subsidies, and privacy protections outlined above.

I respectfully submit this petition and urge Parliament to act swiftly.

Respectfully submitted,

Nhlanhla Hugh Manzini
