On April 15, 2011 at approximately 3:45 A.M. Dawone Taylor was murdered in front of “Giant Burgers” off of 81st and International Blvd in Oakland, California. Pierre Rushing was accused by an unstable drug addict by the name of Robert Green. Robert Green picked Mr. Rushing out of a phony suggested identification 6-Pack line-up after giving the Oakland Police Department 4 different descriptions, which none matched Pierre Rushing. One of the descriptions was given at Mr. Rushings preliminary hearing, Pierre Rushing was asked to leave the courtroom so Robert Green could testify, when Green was asked to give a description of Mr. Rushing—Green was still unable to give a description matching Pierre Rushing.

Dawone Taylor lost his life on April 15, 2011 allegedly over stolen property. When the surveillance tape was retrieved it shows a red Jetta with 4 occupants, 2 exit the vehicle and murdered Dawone Taylor. Pierre Rushing had the video enhanced to clearly show that Pierre was not at the crime scene the time of the murder. The OPD only connected Pierre Rushing to the crime based on the testimony of Robert Green who said the killer’s name was “C” and implemented that “C” is Pierre Rushing. But, anyone who knows Pierre Rushing knows his long time since childhood nickname has always been “Stank” and has never went by “C”.  When OPD retrieve the red Jetta a week after Pierre’s arrest, 18 Latin fingerprints were discovered along with the fingerprint of a Decarla Smith who admitted to being in the car a week before the murder, indicting that the car was not wiped down or tampered with. Along with Ms. Smiths admission of being in the vehicle a week before the murder, Decarla Smith confessed she witnessed the murder and that Pierre Rushing was not at the crime scene. Decarla Smith also admitted that the day of the murder she spotted the red Jetta being driven by a Pat Smith. 

In 2017 at Pierre Rushing’s actual innocence evidentual hearing Pat Smith took the stand admitting that he did drive “C” to commit the murder of Dawone Taylor and testifying that “C” is not Pierre Rushing. When asked to identify “C”, Mr. Smith refused in fear of being labeled a snitch. Pat stated that his only job was to take responsibility for his part so that an Pierre Rushing an innocent man would not have to do the time for his crime.

With all of this evidence presented, they still have yet to release Pierre Rushing, now even with a friend and casual sex partner by the name of  also provided an alibi stating that Pierre and her were at his grandmothers house. Ms. Richardson said she remember the date clearly because her son had a talent show that day and she also remembers it being the last day to file taxes. Not only does Pierre Rushing have an alibi, but since in prison Robert Green has sent in an affidavit admitting that he lied about Pierre being “C”. Even more evidence of Robert Green stating that “C” was on the phone before getting out of the vehicle to commit the murder, but when OPD discovered Pierre Rushing's 2 phones, there was no incoming or outgoing calls made during the time frame of the murder found in Pierre’s call log history.

Pierre Rushing has maintained his innocence since in jail for the past 8 years and counting, Mr. Rushing has faced many untold horror stories along with being behind bars while losing his sister. Prior to being arrested Pierre was pursuing a career in music, along with attending Laney College and has no criminal record. The only thing that connected Pierre to the crime was a testimony from Robert Green who has already admitted to lying about Mr. Rushing committing the murder of Dawone Taylor.

Despite all the facts, testimonies, affidavits, alibis, and evidence they have yet to serve justice by releasing Pierre Rushing, and that is why we need your help. All we are asking is that you sign this petition so justice is served and Pierre Rushing is released.
