Well - it was supposed to be, but this still isn't over. 

Ashley DiFelice appeared in court this morning for what was supposed to be a final court appearance, or at least the hearing to decide the verdict. However in a turn of events the Prosecutor Ekaterine Eleftheriou requested a delay so that additional charges could be filed against Ashley. This is good news! It wasn't stated how many charges would be filed on top of the 17 that she is currently facing or what those charges would be for, but Ms. Eleftheriou said that the additional charges that the state is seeking would be indictable and would be at a county level. This is more good news! Currently her case is being held in municipal court, which is the same court for traffic violations and other minor crimes. The Twist of Fate cruelty case and her fraud and child endangerment are definitely NOT minor crimes. 

FYI, an indictable offense is "a crime that a prosecutor can charge by bringing evidence of the alleged crime to a grand jury. It is a crime for which a grand jury determines that there is enough evidence to charge a defendant with a felony."

Judge Martin Whitcraft confirmed with the Prosecutor that the charges are forthcoming and she stated that after speaking with the defense counsel and the county investigator that the charges would be filed within the next two weeks. She was requesting "a little bit more time to ensure that all of the parties and working parts are in order". The information was then verbally confirmed with Ashley's lawyer, Bill Wackowski. 

The judge then stated that they wanted to get these matters resolved and that could likely happen with the next scheduled appearance "as long as the additional charges do not impact that".

The judge stated that he wanted to discuss Ashley's court case first so that all of the witnesses online weren't needlessly waiting around, which was kind of him. He then let us know that her proceedings had concluded. 

From what I can find, it looks like the next court date is scheduled for Thursday, November 2nd. 

While I am incredibly sad and frustrated that this isn't over yet, I am very hopeful over the good news that was received today with the additional charges and moving the case to a higher court! Moving the case to a different court would put it in front of a different judge and Judge Whitcraft has been good so far, maybe convictions on a higher level would result in a harsher sentence? I don't know, but we'll see what happens. 

 

The horses in the photo above are Everest, Aiyanna, Willow, Beau, and Colton. With this exception of Beau (I don't know where he is or what happened to him), all of these horses are ones that Ashley illegally drove over state lines to her dad's house in PA and as far as anyone knows are still under her and her father's "care".
