Real story (names changed for privacy)
- Harry and Julie have been married for 9 years and live in outer Melbourne. vic.
2. They have 2 children together aged 13 and 10
3. Over the past 24 month Harry and Julie have had some argument although a new behaviour was that Julie would regularly smash something. Over the past months this has escalated to Julie throwing a phone , a vase at Harry.
4. this was the last straw for Harry and he took out an IVO against Julie after the last incident of the vase throwing.
5. Julie applied for her own IVO although it was unsuccessful and the magistrate declined to issue a FVO.
6. Harry left the house to stay at his factory leaving Julie and the children at the house for their convenience and as the meet the distance conditions of the FVO.
7. Harry tried to discuss custody and financial matters and Julie refused to let him see the children although she had no legal standing.
8. Harry issues proceedings in the family court and on the first interlocutory heating DFFH have set conditions that Harry complete a men’s behaviour change course and he is yet to see his children on 6 months.
