Latest Update from SD temporary restraining order

March 17, 2021. The San Diego judge approved a revised temporary restraining order against the State.

The temporary injunction allows ALL school districts in California to open full time right now, but could only be a short window of 2 weeks! The lawsuit was Newsom versus several San Diego parents in several districts.

It is temporary, so there is another hearing on 4/1 to make it more permanent prior to scheduling a trial date. 

The State is prohibited from enforcing:

  1. 4ft minimum spacing rule.
  2. Reopening rules which distinguish between between elementary students and students in grades 7-12.
  3. Framework to the extent that it imposes different reopening criteria for schools serving elementary students and students in grades 7-12 while a county is in the "Purple Tier."
  4. Definition of "Reopen for in-person instruction" (which prevented some schools in the process of slowly reopening from continuing to reopen once their county moved into the Purple Tier.)

FURTHERMORE: School Districts named in the complaint are ORDERED to appear on April 1st to show why they cannot reopen their schools for in-person instruction to the greatest extent possible at the earliest practicable time.
