Statement by Joaquin Cruz Castillo Opposing the Nick Shirley Act and AB 495 I, Joaquin Cruz Castillo, am speaking out against two dangerous legislative proposals — the Nick Shirley Act and AB 495 — because both bills threaten transparency, parental rights, and the true meaning of democracy. These bills use immigration language to make themselves look helpful, but their real impact goes in the opposite direction. The Nick Shirley Act: Against Transparency and Freedom of Speech The Nick Shirley Act claims to protect people, but what it actually does is weaken transparency and limit public participation. It pushes aside the core values of democracy — freedom of speech, accountability, and open government. When a bill restricts the public’s ability to question, speak, or oversee government actions, it is not protecting anyone. It is silencing the community. Society is making it easy because we have forgotten what democracy truly means. AB 495: A Free Key for Outsiders to Make Decisions About Your Children AB 495 goes even further. It opens the door for individuals — even those not directly connected to a child’s life — to make decisions about that child. This is not protection. This is unchecked authority, and it puts families at risk. Both bills are being sold under the idea of “protecting immigrants.” But we must ask: Who keeps repeating that immigrants are in the shadows, scared, or unable to access services? It is the same political voices claiming to fight for immigrant communities — while keeping those communities marginalized.
