

James Franco, 43, and Elon Musk, 50, were subpoenaed on October 26, according to court documents. They were ordered to “produce the books, record, electronically stored information and tangible things designated and described” — including “verbal conversations, telephone calls, letters, emails, memoranda [and] reports” — by January 17, 2022. The documents request that any communications between the men and Heard, 35, relating to allegations of physical injuries or harm sustained by her as a result of alleged conduct by Depp, 58, and allegations of physical abuse or domestic violence committed by either party be turned over.
Musk is scheduled to be deposed on January 24, 2022, while Franco is scheduled to be deposed on January 26, 2022.
The question is whether or not they’ll comply.
Musk has notoriously evaded giving any testimony throughout Johnny Depp’s ongoing legal woes with his ex-wife Amber Heard. Will he show up to sit for his deposition? Will he turn over all of the communications described above?
Musk is on CCTV being snuck into Depp’s condo to spend quality late-night time with Heard while Depp was away working. He was seen in Heard’s company on or about the dates that Heard claimed to have been abused by Depp. And I’m willing to bet that he, Musk, saw Heard up close and personal. So he’s in a position to say whether or not he saw any actual injuries on her. What will he testify if asked that question? Other people have already said that they saw her on and around those dates with no injuries. Will Musk say the same? Is he willing to perjure himself for her?
If they actually get Musk to sit for his deposition, I guess we’ll see what he says.
As for Franco, he also spent quality time with Heard in Depp’s condo while Depp was away, so he also got what I’m guessing is a very good look at her. Besides which, he lived in the same building, so he had lots of chances to see Heard with or without injuries. What will he say?
Depp vehemently denies that he ever abused Heard, and insists that he’s dedicated to clearing his name. He says: “Ultimately, the truth will come out in all of this and I will be standing on the right side of the roaring rapids. I hope other people will be too,” he said, adding: “I will never stop fighting. I’ll never stop.”
The 50 million dollar defamation suit is set to get underway early in 2022. In the meantime until then, motions are being heard and depositions are being collected.
