Proceed by indictment and recommend the maximum penalty, IF convicted, for those accused of attacking their family dog, Bryn

According to the BC SPCA, Bryn is a shy but affectionate 6- or 7-year-old pit bull cross who came into their care in early April 2014 suffering from severe injuries that appeared to be caused by blunt force trauma. According to BC SPCA Constable Erika Paul, “when she came into our care Bryn had extensive injuries to her head, torso, legs and teeth. Her skin was split open on the top of her head and she had bruising around the right side of that injury, as well as a swelling and broken front leg, lacerations under her left armpit and abrasions on her front right leg. Bryn also had significant bruising to the right side of her torso, a broken canine tooth and was experiencing neurological deficits that impacted her back legs, making it hard for her to stand or move around.” The SPCA also reports that medical care was not sought for Bryn until they became aware of her injuries, at which time “the SPCA immediately rushed Bryn for emergency treatment and launched a formal investigation into the beating.”
Joseph White and Elizabeth Johnston have both been charged under the Criminal Code of Canada with failing to provide the necessaries of life for an animal, and Joseph White has also been charged with causing unnecessary pain, suffering, or injury to an animal. They are presumed innocent until proven guilty.
We the undersigned respectfully request that Crown Counsel proceed by way of indictment in this case and that, if Joseph White and/or Elizabeth Johnston are found guilty of one or more of the charges of animal cruelty in relation to Bryn, Crown Counsel recommend to the Honourable sentencing Judge the maximum sentence available under the law. In addition, if convicted, we request that in accordance with Section 447.1(1)(a) of the Criminal Code of Canada, the court “make an order prohibiting the accused from owning, having the custody or control of or residing in the same premises as an animal or a bird” for the rest of his and/or her lifetime and that the court order the person(s) to pay to the SPCA the amount expended on Bryn’s rehabilitation.

NOTE: The National Link Coalition states that animal cruelty is a crime that is a red-flag indicator of the potential for the animal abuser to be participating in other criminality, including violence toward humans, either simultaneously or in the future. It is thus imperative that the criminal justice system deals with the crime of animal cruelty appropriately, to ensure the safety of both animals and humans.
