This is amendment  AM0004-21, is another attempt to make the Linscott pit legal, by allowing their nonconforming gravel pit to be able to grow to their property lines instead from their size from 1981 which is now approx. 400% beyond what is legal in the Bonner County code. 

If this amendment passes this could allow the Linscott pit to grow from the 115 acres it is now, to over 200 acres.

This amendment is not legal according to our attorney, Gary Allen from Givens Pursley.

This could DOUBLE the size of grandfathered Linscott pit, and up to 90 other grandfathered gravel pits in Bonner County.(Right now nonconforming land can grow from 1981 up to 10% without a permit, and up to 50% with a permit. Linscott gravel pit has NO PERMITS.


Please write to letter, expressing your frustration as the county continues to attempt to change the laws to make the Linscott pit legal, as Gary explained, this is called spot zoning and is unlawful.

Also very concerning for the County is Planning and Zoning are attempting to change the time limit of what is considered abandoned nonconforming land for the resource code based use, which includes mines, gravel pit, open pits, and more, that come back in existence approximately 10 years after abandonment. (it’s now two years)

Take a moment to tell the Planning and Zoning Commissioners you don’t want growth, or expansion, to nonconforming land uses to change from the 1981 laws we have now. 


Nonconforming land growth should be limited to the size they were when the zoning was changed in 1981, and not have a new start to be able to expand to their property line edges.
