ACTION ALERT: Call your Senators to oppose the nomination of innocence-denying Catherine Lhamon, who has been nominated to head up the Office for Civil Rights. Here’s the phone number: (202) 224-​3121.

Advocates of victim-centered investigations seldom admit their belief that sexual assault complainants are always telling the truth. But yesterday, during a Senate hearing, Catherine Lhamon -- pictured above -- who has been nominated to head up the Dept. of Education's Office for Civil Rights, let the cat out of the bag.

First, Lhamon told the Senate Committee a falsehood, claiming that the new Title IX regulation doesn't say anything about the presumption of innocence. That's NOT TRUE.

The regulation clearly states the grievance process must:

  • “Include a presumption that the respondent is not responsible for the alleged conduct until a determination regarding responsibility is made at the conclusion of the grievance process.” (Section 106.45(b)(1)(iv))

Lhamon then doubled-down on her comment, saying that Title IX adjudicators “should be open to the possibility” that the accused student isn't guilty. 

"Open to possibility" means that in almost every case, the allegation is true. But there is a one-in-a-gazillion chance of a false accusation, they will admit.

Which is the rationale used by Start By Believing ideologues. "Why go to all the expense and trouble of launching an impartial investigation, when the accused is almost certain to be guilty?" they proclaim.
