Yesterday the Court of Appeals issued two opinions, both in favor of Dallas Pets Alive! and Rusty.

First the Appellate Court held that Dallas Pets Alive had the right to file for a temporary restraining order while the appeal of the municipal court order was being processed. Second, and more importantly, the Court held that Dallas Pets Alive has the right to appeal the municipal judge’s order of euthanization.

Unless the City prolongs the case by filing additional appeals, the case will finally go back to the trial court for a legal and evidentiary review of the municipal court’s ruling.
