PRESIDENTIAL ACTIONS DECLARING A NATIONAL EMERGENCY TO SECURE THE UNITED STATES BULK-POWER SYSTEM

The President has declared a national emergency involving the security of the U.S. bulk-power system and the order expressly includes battery energy storage systems (BESS). Before approving additional BESS facilities, the proposed facilities must not use foreign-produced equipment, foreign-controlled technology, software, firmware or remote-access systems that could present the very risks identified by the federal government. If any of BESS batteries, inverters, software, firmware, control systems, or other equipment including digital services or remote-access capabilities come from restricted foreign sources; the project could face additional federal review and potentially be required to change or replace that equipment.
