
I went to the courthouse on Monday 4/19 to request a trial by written declaration. Began to set up an appointment when the receptionist on the phone said I can’t set an appointment because my ticket does not exist in their system. She clarified that although I have a physical copy of my ticket the officer still needs to file it on his end. May I remind you that I was cited on 2/27/21. I have until 5/23/21 to take care of my ticket. The receptionist said the officer has a year to file it. I saw that in order to declare a written declaration I need paperwork from the courthouse and must have my letter post marked 5 days before my due date. I’m not pointing fingers or assuming but I hope the officer is not purposely waiting to file his ticket so that I lose out on my ability to write my letter. The CHP officer at the front desk said to continue to check for an update and log everything related to it. I can use this as defense in my trial.
