Hello supporters,

The temporary resident pathway for extended family members in Gaza has been a tragic failure. The Government of Canada has failed to ensure the fair, timely and transparent processing of these urgent applications amidst an ongoing genocide.

We, along with other immigration and refugee lawyers, are initiating litigation before the Federal Court on behalf of applicants of this pathway. The objective is to put pressure on the government and hold them accountable for the promises they have made to Palestinian-Canadian families.

Please note that the litigation is limited in scope. It is not a challenge to the nature of the pathway, the eligibility criteria, the application requirements or the cap.

The litigation will be limited to applicants who fall under one of the following 3 groups:

GROUP 1: Applicant who submitted a complete crisis webform and have not received a unique reference code. The order that will be requested is called a writ of mandamus, which, if granted, will compel IRCC to issue codes to the affected applicants.

GROUP 2: Applicants who submitted the crisis webform and received a refusal letter from IRCC stating that they are ineligible for submitting an incomplete statutory declaration form. The order that will be requested is to set aside the refusal and send the application back for redetermination.

GROUP 3: Applicants who have been issued a code, submitted a complete TRV application and have not received a decision. The order that will be requested is called a writ of mandamus, which, if granted, will compel IRCC to complete the processing of the TRV application.
