Further Potential Payment for Aviva TripleGuard Policyholders             

Earlier this year, through the signing of a petition and our collective efforts, we successfully put pressure on Aviva to make  payments to dentists under the Aviva TripleGuard Policy.  However, you may be entitled to significant additional payments from both Aviva and our insurance broker CDSPI.  

A large group of more than 1,600 Canadian dentists and dental offices, including many of you, have retained a leading national law firm, McCarthy Tétrault  LLP, to pursue legal claims against insurance companies and brokersfor business/practice interruption loss resulting from COVID-19.

McCarthy Tétrault is pursuing claims by dentists against Aviva for business interruption loss, even if pandemic coverage has already been paid.

In addition, McCarthy Tétrault is now also advancing claims against CDSPI to recover additional funds on behalf of dentists with Aviva’s TripleGuard coverage who were not advised by CDSPI of the opportunity to increase the limits of their Pandemic Coverage in response to the developing COVID-19 crisis. Until approximately mid-March 2020, Aviva permitted existing TripleGuard policyholders to increase the limit of their Pandemic Coverage from a minimum of $20,000 to a maximum of $100,000 per clinic. If you were not advised of this opportunity you may have a claim against CDSPI for a further “top up” payment of up to $80,000 per clinic (depending on the limits of your existing coverage).

Significantly, McCarthy Tétrault has been officially retained on a full contingency basis.  As a result, dentists who wish to protect their legal rights and pursue legal claims DO NOT have to pay any amount for legal fees, and are not exposed financially in the event that claims are unsuccessful.
