I am informed that impacts of the development on the amenities of adjoining residents cannot be a consideration.Regarding 115 Mandeville Road, I have enquired with officers on this application, and I understand that Application reference 24/01612/CEA was received and is a Certificate of Lawfulness application seeking confirmation that the change of use of the property from use class C3 ( dwelling house) to use class C2 ( residential institution) would not require planning permission.
The dwelling would be a children’s home for up to two children with up to 3 carers, two sleeping overnight working on a rota basis is lawful. This may also be considered as C3b, living as a family where care is provided.
I am advised that given the type of application, which is an assessment of the facts of the case and whether the development is or is not lawful, no consultation is carried out/required. However, objections have been submitted raising concerns about the use. The application will need to be considered on the basis of whether the development is lawful or not. I am informed that impacts of the development on the amenities of adjoining residents cannot be a consideration.

The application is with the case officer and is due for determination by 24th July. It is also advisable to contact your local councillors to raise deputations for this application.
I do appreciate the concerns that you have raised, but hope this email is helpful in explaining why I cannot be of further assistance on this occasion.

Thank you for your response regarding the application at 115 Mandeville Road.

I am extremely frustrated with the dismissal of community impact in the Certificate of Lawfulness process. Changing a property from a dwelling house (C3) to a children's home (C2) or possibly C3b significantly affects the neighborhood. Ignoring potential issues like increased traffic and noise is unacceptable.

The lack of public consultation in this process is troubling and seems undemocratic. Other planning matters consider community impact and public opinion, so it is inconsistent for this change to be exempt from such scrutiny.

You have informed us that you cannot assist us in this matter, but I urge you to reconsider this approach. If the Certificate of Lawfulness prevents you from considering community impact, then a different process should be in place to ensure our concerns are addressed. If contacting local councillors is our only recourse, please confirm this.

Our concerns are crucial for the well-being and stability of our community, and more must be done to integrate community feedback in these decisions.
