The Village of Palmetto Bay gives notice that at the request of the Village Attorney, a Special Meeting of the Mayor and Village Council will be held for the purpose of holding an Attorney-Client Executive Session regarding the legal action styled Yacht Club by Luxcom, LLC v. Village of Palmetto Bay, Circuit Court Case No. 2020-023918-CA 08. The Village Attorney desires advice from the Village Council regarding settlement negotiations and litigation expenditures.
The Special Meeting and Executive-Session is to be held on Monday, October 20, 2025, at 4:00 p.m. at the Village of Palmetto Bay Municipal Center located at 9705 East Hibiscus Street, Palmetto Bay, FL 33157. The Executive-Session will take approximately half an hour.
Pursuant to Section 286.011 (8), Florida Statutes, the Executive-Session will be closed to the public. Present at the Executive-Session will be Mayor Karyn Cunningham, Vice Mayor Mark Merwitzer, Councilmember Patrick Fiore, Councilmember Steve Cody, Councilmember Marsha Matson, Village Manager Nick Marano, Village Attorney John Dellagloria, Special Counsel John Quick, Alicia Gonzalez, Pete Waldman, and Ed Martos.
A certified court reporter shall record the time and termination of the Executive- Session, all discussions and proceedings that occur, the names of all persons present at any time during the Executive Session and the names of all persons speaking. The transcript shall be made part of the public records upon conclusion of the litigation. All discussion held during the Executive-Session is to remain confidential until the conclusion of the litigation.
