Sub: Our Grievances related to Woodsville and Synergy one marketing Pvt Ltd., who came up with proposals for a gated community project at Anekal
Ref: Recent amendments to Real Estate Development and Regulation Act notified by Government of India after getting the assent of Hon'ble President of India and the rules framed there on by Govt of Karnataka that enables to deal sternly with erring and cheating Developers, Builders and Promoters
With reference to the above, we wish to introduce ourselves as the Association formed with name & style as above in Oct'2013 to protect the interests of about 175 of our members for a peaceful living in the said premises when once all our properties are handed over to us successfully.
Woodsville projects Pvt ltd., a company incorporated under companies Act 1956, (CIN/LLPIN No. U70102DL2010PTC250187) having its office at Row House No.1, Gold Field Enclave, South Main Road, Koregaon Park, Pune - 411 001, an off shoot of Pearls group (PACL) located at New Delhi, jointly promoted by another company called Synergy one Marketing Pvt Ltd.,( for developing and marketing Wooodsville Projects) having its office at "Synergy House" Opp. Kendriya Vidyalaya, NH &, Air Port Road Bengaluru - 560 064 have launched the first phase of the above project at Anekal a southern suburb of Bengaluru city almost quite near to Electronic city offering 400 plots during August 2011 which were 100% booked.
Based on the tremendous response, they have launched the second phase of the project with another 400 plots during April' 2012 which were also booked 100%. The entire project cost is estimated to be around 100 crores. While on the subject we wish bring the following few points also for your perusal and consideration.
1. Besides the statutory infra structural facilities as above, Woodsville has collected a sum of Rs. 50000/- from each plot/villa applicant towards Club House.
2. Their Ad for selling plots/villas have been released full page for three consecutive days during Aug'2011 for Phase I and again in April'2012 for Phase II.
3. They have projected in all their Ads one Ms. Ramya a popular actress of Karnataka at that time as their Brand Ambassador for launching their projects.
4. They have also ensured that senior officials from all leading banks are available to sanction spot loans for the project, just to make gullible investors believe that they are genuine and honest in launching their projects and will take off to hand over the properties on time.
5. They were willing to accept even any amount less than the minimum of Rs. 1 lac prescribed as advance for booking which clearly showed that they somehow wanted to ensure that all the plots/villas are booked.
The precondition from BMRDA for according approval for this project is that Woodsville is permitted to sell 60% of the total plots directly to the intending buyers and go ahead with their Registration. However, the remaining 40% of the plots are with held by BMRDA for release only after the completion of all development jobs such as water supply, sewage, power and black topped roads.
It is at this point only trouble has started for us. Synergy one personnel who are responsible for completion of all development jobs have not discharged their obligations in spite of reminders through mails and written letters. One fine day they informed that Woodsville have handed over the development jobs to another company called Citrus Ventures Pvt Ltd., also located at Bengaluru. When we contacted Citrus Ventures they did agree that they have taken up the development jobs and assured us that they would be completing the same at the earliest.
However after some time when we found that no significant progress has been made, we once again approached Citrus for updates. At that point of time they informed that they have already spent a few crores of money for settling the dues left over by Synergy to the earlier contractors and Woods ville is refusing to flush in fresh funds to enable them proceed further for appointment of new contractors for continuation of executing the jobs.. Therefore they are not finding the project viable and hence left.
While we could not find any other way but to resort to legal remedies, we convened our General Body Meeting during Mar'2014 to get members approval for initiating legal action against both Woodsville and Synergy one. It was during this meeting one Mr. Ram tandon Asst. Vice President (Marketing & Sales) appeared on behalf of both Woodsville and Synergy one. He informed us the left-out development jobs at the site have now been entrusted to another company called Valmark and offered to put us to their Director Mr. Ratan Lath for further discussions on the subject.
Accordingly a meeting was arranged by him between us and we discussed all the issues thread bare. Mr. Ratan lath did accept that they have taken over the project development and would be completing the same at the earliest. He also showed us an agreement entered into to that effect with Woodsville. At this juncture we insisted that Valmark may execute an agreement with the Association undertaking to complete the jobs within a fixed time frame as we had already burnt our fingers with the other two companies viz., Synergy one and Citrus. For this Mr. Ratan said that they do not have any locus standi to execute any undertaking to the Association as the two are two different entities having no links. He however suggested that he would organize for signing a memorandum of understanding between Woodsville and the Association. Accordingly, we have submitted our draft MOU duly vetted by our Lawyer and requested Mr. Ratan to arrange for completing the other part. In the meantime Mr. Ratan wanted details of our members to reconcile with that of the one provided to him by Synergy one and we have readily parted with the info to him.
However, the signing of MOU was not taking place as Mr. Ratan informed that the Directors of Woodsville are away and it may take some more time. At this point of time Mr. Ratan advised us for proceeding further for registration of properties under 60% category and we asked for the details of signatories to the execution of sale deed and the original documents for verification.
It is at this stage during one of the meetings with Valmark, the legal adviser for Woodsville/Synergy namely Mr. Harsha Joshi appeared on the scene and informed us that there was a CBI raid at the premises of PACL (Pearls Group) at Delhi about the Ponzy scam and that they have seized all the documents of Pearls group including Woodsville both at Delhi and Mumbai and frozen all their bank accounts also. However he added that they have filed an application with CBI Court that the Documents pertaining to Woodsville have nothing to do with Ponzy scam and that they requested them to release those docs besides defreezing of their bank accounts also. There after he never came back to us with feedback.
When we asked Mr. Ratan regarding completion of development jobs, he expressed his helplessness stating that he had also spent lot of his company’s money for paying dues not honored by Woodsville and when approached woods ville for release of funds to proceed further, it seems they expressed their inability citing freezing of their bank accounts. Mr. Ratan ultimately informed us that he is also walking out of the project as there was no progress.
Thus, we have gone one full circle and in our efforts to find solutions to our problems and came back to square one.
Back to our hunt for further solutions, we have represented our pathetic situation to BMRDA the approving authorities of the project, Anekal Planning Authorities and the then Industries Minister Shri. Ramalinga Reddy Government of Karnataka who hails from Anekal. As there was no response, we have filed Police complaints against all the concerned at the jurisdictional Police station at Attibele. Although they have acknowledged our complaint and registered the same there was no further progress. We then lodged requisite complaints with the Bengaluru city Police Commissioner and head quarters of BMRDA also. Even then we could not see any expected results. Later we represented to Sub Registrar Anekal jurisdiction not to entertain any registrations in respect of our site as we came to know that Woodsville is trying to sell all unsold plots in 60% category. A similar request was made to Besom authorities at Anekal requesting them not to entertain any requests from Woodsville for power connections until they fulfil their obligations to our members first.
Some of our members have also filed individual complaints at Attibele Police station and an FIR has been registered under ref The FIR NO 176/2017, under sections 403,406,420,120(b) read with 149 of INDIAN PENAL CODE.
Even filing of FIR did not result in any desired action by Police. Therefore we are of the firm opinion that the cases against Woodsville & Synergy one must be transferred to CBI or at least State CB CID for speedy action
Not stopping with that we have organized a protest meet at freedom park Bengaluru to attract the attention of every one including government authorities with requisite police permission on Sunday the 7th Jun'15, which event was telecast the same day at 10-30 pm.
As a penultimate attempt, we dropped our representations at the Vidhan Soudha Secretariat at the Chief Minister's Public Grievances cell and Home Minister's office with a hope that something would happen.
In the mean time, PACL New Delhi had released an advertisement in The Times of India dated 3rd May 2015 assuring all their customers that the company is committed to fulfil commitments towards them. The advertisement further adds that PACL Management further assure all its customers that their interests are safe and secured with the company. In response to this Ad, we have made a written representation to PACL on 06-05-2015 requesting them to sympathetically consider our case, for which there is no response from them till date.
Not only this, there were lot of press clippings about Woodsville, Synergy one and PACL making charges and counter charges against each other, copies of which are also available with us. All these said clipping copies together with copies of all the representations & reminders sent to the Directors of both Woodsville & Synergy one , representations made to all the Government bodies in Karnataka Government and the Police complaints lodged etc., will be submitted to you when once we hear from you to that effect.
Based on another news item in the media wherein Supreme court has directed SEBI to form a committee to redress the grievances of all investors and depositors of PACL, we have made a representation to them also highlighting all our issues and requesting their intervention.
While we were thinking that all avenues were closed for us except seeking legal remedies which is often expensive and time consuming, the news from media about amendments to realty act has come as a blessing in disguise for us. We have immediately lodged a complaint with RERA Karnataka chapter highlighting our problems and requesting their intervention. Our compliant was duly acknowledged by RERA Bengaluru vide Complaint Ref CMP/171213/0000326.
As we have not heard anything even from RERA authorities also, we are left with no other option but to approach your good offices for necessary intervention and speedy redress of grievances
We therefore request you to kindly intervene and arrange to issue suitable instructions to the concerned officer of the Housing and Urban Development Ministry besides BMRDA & Anekal Planning authorities through Government of Karnataka to take up our case on a war footing, since hard earned monies to the tune of hundreds of crores of rupees of the gullible investors were swindled away by the promoters and developers namely Woodsville projects and Synergy one Marketing Company.
To sum up we enumerate below the details/modes of reliefs that are required by us to save our hard earned money.
1. Arrange for bringing Woodsville & Synergy one under the ambit of RERA and instructing them to complete the project in full and in all respects.
2. If not, to pass necessary orders directing either Karnataka Government or any other well reputed Developer/Builder to take over the project for completion.
3. To transfer all the complaints and FIRs lying at Attibele Police station either to CBI or State CB CID for expeditious action to trace the culprits and arrest them
We are willing to extend all the required cooperation in this regard for successful completion of the project.
